1054.02 APPLICATION; ISSUANCE; INSPECTION; SCOPE; FEE.
   (a)    Any person, firm or corporation who or which is a resident of the Village of Loudonville and who or which wishes to dump any materials as provided in Section 1054.01 shall apply to the Village Council for the required permit.
   (b)    The permits shall authorize the dumping of clean fill only and shall specifically prohibit the dumping of papers, cans, tires, rags, garbage, appliances, treated lumber, demolition material and any other materials not falling within the definition of clean fill. No permit authorizing the dumping of clean fill shall be issued by the Village except under extraordinary circumstances or as may otherwise be reflected in the minutes of the Council of the Village of Loudonville.
   (c)    Upon the issuance of a permit as set forth herein, the Village Council shall have the discretion of requiring the inspection of any or all materials to be dumped under the authority of such permit.
   (d)    For the purpose of this section, "clean fill" includes only the following: fill dirt, tree limbs, leaves, lumber (not including wolmanized or pressure-treated lumber) and only such other items as the Council of the Village of Loudonville may authorize. "Clean fill" specifically excludes any and all items prohibited by the Ohio Environmental Protection Agency, as well as by State statute, which may not be disposed of or deposited in any landfill or other refuse site except when deposited in an appropriately licensed waste disposal facility.
   (e)    A permit can be purchased daily or for up to and including a five-day period.
   (f)    There shall be an application fee of three dollars ($3.00) per day, payable at the time of the purchase of the permit.
