§ 91.11 DESIGNATED OUTDOOR REFRESHMENT AREA (DORA).
   (A)   Pursuant to R.C. § 4301.82, this Council hereby creates a designated outdoor refreshment area (DORA) to include the area as follows:
      (1)   Beginning at a point in the centerline of Walnut Street and Second Street; thence with the center of Second Street; passing Mulberry Street, Market Street, and Spring Street; west a distance of 1,831.50 feet to a point in the centerline intersection of Second and High Street; thence leaving Second Street and with the center of High Street, passing Main Street, north a distance of 775.50 feet to a point in the centerline intersection of High Street and Hunter Street; thence leaving the center of High Street and with the centerline of Hunter Street; passing Spring Street, Market Street and Mulberry Street; east a distance of 1,831.50 feet to a point in the centerline intersection of Hunter Street and Walnut Street; thence leaving the center of Hunter Street and with the center of Walnut Street, passing Main Street, south a distance of 775.50 feet to the point of beginning.
      (2)   The above description of eight city blocks of the City of Logan including parts of city streets encompasses 32.606 acres of land.
      (3)   The above survey was written by Larry Gerstner registered surveyor number 6344 on May 28, 2022.
   (B)   All existing land uses within the proposed DORA are in zones B2D, B1, M or R3, and are currently compatible with the city's master zoning plan and map.
   (C)   The following public health and safety measures will be maintained within the DORA as specified below:
      (1)   Signage: Twelve DORA signs will be placed at all boundary intersections.
      (2)   Logan City Police Department staffing of two sworn officers during DORA planned hours.   
      (3)   House of operation are 11:00 a.m. to 11:00 p.m. Monday through Saturday.
      (4)   Sanitation plan: The City Service Director will contract with whomever he sees fit to remove trash from the downtown DORA area. This trash will need to be removed twice a week from the on-street receptacles. The city will have ten three-gallon trash cans located around the DORA area. In addition, the city has one full-time and two part-time code enforcement officers who will cite any business not in compliance with the city code, which requires properties to be free of trash and debris. The street sweeper will be operated on the days after the twice weekly trash pick-up. When special events occur, the organizers of the event will be responsible for the removal of all additional trash.
      (5)   Staff to carry out the sanitation plan: The Director of Code Enforcement and his staff will monitor and cite problems that may occur in the DORA.
      (6)   Containers: The use of 12 ounce 100% compostable, single use cups will be required. Each cup will be printed with the main rules and the name of the establishment from which the drink was purchased within the DORA.
   (D)   In accordance with R.C. § 4301.82(I)(1), City Council shall, five years after the date of creation of the DORA, review the operation of the area and shall, by ordinance, either approve the continued operation of the area or dissolve the area.
