ADOPTING ORDINANCE

ORDINANCE NO. 27, 1992

AN ORDINANCE TO ADOPT CURRENT REPLACEMENT PAGES TO THE CODE OF ORDINANCES, AND DECLARING AN EMERGENCY.

   WHEREAS, certain provisions within the Codified Ordinances should be amended to conform with current State law as required by the Ohio Constitution; and

   WHEREAS, various ordinances of a general and permanent nature have been passed by Council which should be included in the Codified Ordinances; and

   WHEREAS, Council has heretofore entered into a contract with American Legal Publishing to prepare and publish such revision which is before Council; now therefore:

   BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LOGAN, STATE OF OHIO:

   Section 1: That the ordinances of the City of Logan, Ohio, of a general and permanent nature, as revised, recodified, rearranged and consolidated into component codes, titles, chapters and sections within the 1992 Replacement Pages to the Codified Ordinances are hereby approved and adopted.

   Section 2: That the following sections and chapters are hereby added, amended or repealed as respectively indicated in order to comply with current State law:

   33.01 - 33.27   Police and Fire Divisions (Amended).

   70.01 - 70.04   General Provisions Definitions (Amended).

   71.10 - 71.99   Licensing Provisions (Amended).

   73.01      Driving Under Influence (Amended).

   73.02      Driving with impaired alertness or ability (Amended).

   73.05 - 73.31   Motor Vehicle Crimes (Amended).

   74.39 - 74.44   Equipment and Loads (Amended).

   75.01 - 75.03   Bicycles and Motorcycles (Amended).

   76.05 - 76.06   Parking Regulations (Amended).

   90.01 - 90.05   Animals (Amended).

   90.11 - 90.99   Animals (Amended).

   130.01 - 130.06   General Provisions (Amended).

   130.10 - 130.99   General Provisions (Amended).

   131.01 - 131.03   Offenses against Property (Amended).

   131.06 - 131.14   Offenses against Property (Amended).

   132.01 - 132.03   Offenses against Public peace (Amended).

   132.13 - 132.15   Offenses against Public peace (Amended).

   133.02 - 133.05   Offenses against Morals (Amended).

   134.01 - 134.09   Gambling (Amended).

   135.15 - 135.99   Offenses against Persons (Amended).

   136.01 - 136.13   Offenses against Justice (Amended).

   Section 3: That this Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, welfare and safety and for the further reason that there exists an imperative necessity for the earliest publication and distribution of current replacement pages to the officials and residents of the City, so as to facilitate administration, daily operation and avoid practical and legal entanglements. Wherefore, provided it receives the affirmative vote of two-thirds of the members elected to the legislative authority, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
