§ 30.071 ASSESSMENT AND COLLECTION.
   (A)   The assessment and collection of the annual Solid Waste Availability Fee in the City of Locust shall be as follows:
      (1)   There is hereby imposed a Solid Waste Availability Fee on each residential dwelling unit or commercial building unit in the city benefitting from the availability of solid waste disposal facilities in the city . For purposes of this subchapter, COMMERCIAL BUILDING shall include any building used for business or charitable enterprise. COMMERCIAL BUILDING shall include churches, and buildings owned by organizations exempt from ad valorem taxes. Each separate space within a commercial building shall be a separate unit. A structure may contain both residential dwelling and commercial building units. Owners of residential dwelling units who meet the criteria set out in G.S. § 105-277.1 (Property Tax Homestead Exemption) shall not be required to pay the availability fee.
      (2)   The Solid Waste Availability Fee will be set by the City Council and the fee schedule shall be determined annually by the City Council and adopted as part of the City of Locust Budget Ordinance. The owner of a mobile home park will be charged for each residential unit. The owner of an apartment building will be charged for each apartment. The owner of a commercial building will be charged for each commercial building unit on the property. Property owners are required to notify the county tax office when additional structures, residential dwelling units, or commercial building units are located on the property.
      (3)   The Solid Waste Availability Fee will be billed with ad valorem taxes and in the case of non-payment, may be collected in any manner by which delinquent taxes may be collected.
      (4)   In return for payment of the Solid Waste Availability Fee, households and other entities will be allowed to dispose of tires, appliances, metals, cement block, brick, concrete, asphalt, oil, household quantities of furniture and paint, antifreeze, approved recyclables, uncontaminated dirt, and yard waste as scheduled by the city. Solid waste and other forms of construction and demolition waste are not included in this list.
   (B)   All ordinances in conflict with this subchapter are hereby repealed.
