§ 94.65 OPEN BURNING PROHIBITED.
   The open burning of any paper, garbage, refuse, waste, or any vegetable or plant or refuse, including, but not limited to, tree trimmings, weeds, leaves, grass, yard trimmings, and crop residues, or any other combustible material, is hereby prohibited, with the exception that fires set by a public official in the performance of an official duty shall be allowed, as shall fires used for private or public recreational purposes, as well as fires in outdoor fireplaces designed for cooking food. However, no fire referred to hereinbefore shall be used as an incinerator, or shall be permitted to become a nuisance or a source of annoyance or discomfort to any other person by reason of the emission of smoke, fumes, fly ash, dust, or soot.
