§ 150.165 RECOMMENDATION AND DECISION ON SPECIAL USE PERMITS, STANDARDS.
   (A)   The Plan Commission may make a recommendation of approval, and recommend conditions as may be reasonably necessary to meet the standards of this chapter, on a special use permit without further public hearing by simple majority vote, provided that such special use, as conditioned, is:
      (1)   Protective of the public health, safety, and welfare;
      (2)   In keeping with the general purposes of this chapter;
      (3)   Consistent with the characteristics of the general nature of the area in which the special use is to be located.
   (B)   The City Council may grant a special use permit that received a recommendation of approval without further public hearing by simple majority vote. The City Council may add to, delete, amend, or modify any conditions set forth in the Plan Commission’s recommendation by simple majority vote. Any proposed special use which fails to receive a recommendation of approval of the Plan Commission shall not be approved by the City Council except by a favorable majority vote of all members of the City Council then holding office.
