7-5-21: CROSS CONNECTIONS:
   (A)   Cross Connections Prohibited:
      1.   Connections between potable water systems and other systems or equipment containing water or other substances of unknown or questionable quality are prohibited unless approved cross connection control devices or methods are installed, tested, and maintained to ensure proper operation on a continuing basis.
      2.   No physical connection shall be permitted between the potable portion of a supply and any other water supply not of equal or better bacteriological and chemical quality as determined by inspection and analysis by the Illinois environmental protection agency. An "approved cross connection control device" shall be one which is approved by the regulations promulgated from time to time by the Illinois environmental protection agency and the Illinois pollution control board and as approved by the public works director or his designee (hereinafter the "director").
   (B)   Cross Connection Control Required:
      1.   The director shall determine if an approved cross connection control device is necessary for any establishment that has a connection to the village waterworks system. The director shall give notice to the property owner or customer that an approved cross connection control device is to be installed on the service line from the village waterworks supply to the premises being served by said supply. The type of device and installation method shall be as approved by the director.
      2.   All cross connection devices and appurtenances are to be purchased, installed, and maintained at the sole expense of the property owner or customer.
      3.   The following establishments shall be exempt from the requirements of this section:
         (a)   Single-family and multi-family residential dwellings, not used for business purposes, whose water supply plumbing is plumbed in accordance with a plumbing code at least as stringent as the Illinois state plumbing code as from time to time amended.
   (C)   Location Of Cross Connection Control Devices:
      1.   Cross connection devices shall be installed in a location as approved by the director.
      2.   The devices shall be located in a manner that readily facilitates maintenance, testing, and repair and that does not create a cross connection. Cross connection devices shall be protected from frost. Cross connection devices shall include an isolation valve with test cocks on each side of the cross connection control device.
   (D)   Surveys And Investigations:
      1.   The director shall cause surveys and investigations of properties serviced by the village waterworks system to be performed every two (2) years to determine whether potential or actual cross connections exist. The purpose of this survey is to compile and update an inventory of devices. It must consist of a pencil and paper collection of information, conducted by telephone, mail or personal visit to the manager or owner of a specific property. It is not intended to include an actual visual inspection of piping or plumbing systems.
      2.   The director, or authorized agent shall have access as permitted by section 7-5-15 of this chapter as amended from time to time.
   (E)   Testing And Repair:
      1.   Cross connection control devices shall be tested immediately upon installation and tested annually thereafter by a certified cross connection control device inspector (CCCDI). The results of each test shall be immediately reported to the director.
      2.   Faulty devices shall be repaired or replaced within one day for an air gap device, and within five (5) days for double check valves or reduced pressure backflow preventers by the property owner or customer. However, if the director finds that an unprotected connection poses an immediate hazard to the public water supply, the director may require repair or installation in less than the one or five (5) days specified herein, or may order disconnection of the hazard until an approved device is properly installed and tested.
      3.   All costs to test, repair and/or replace cross connection control devices, as well as the hiring of a CCCDI, shall be at the sole expense and responsibility of the property owner or customer. Record of inspection, testing, and/or repairs shall be submitted to the director. Each device shall have a record of maintenance available on site. Said record shall have dates of tests, inspector's name and CCCDI license number, type repairs, and test results. Maintenance of devices shall be as recommended by the device manufacturer. The manufacturer's maintenance manual shall be available on site.
   (F)   Disconnection Of Service:
      1.   The director shall be authorized to discontinue water service to any property wherein a cross connection violation exists as herein provided.
      2.   However, water service may be discontinued only five (5) calendar days after notice is given to the property owner or customer via regular first class mail. Notice shall be deemed given on the day it is deposited in any main or branch United States post office.
      3.   The director shall be authorized to discontinue service without notice to the property owner or customer to prevent actual or anticipated contamination or pollution of the village waterworks supply if the actual or anticipated contamination or pollution poses an immediate hazard to the public water supply.
      4.   The village shall not be held liable for any injury, damages, or lost revenues which result from discontinuation of property owners' or customers' water service in accordance with the provisions of this section.
   (G)   Reconnection Of Service: Water service shall not be restored until all of the conditions that warranted disconnection are eliminated or corrected to the satisfaction of the public works director, in compliance with the provisions of this section.
   (H)   Contamination And/Or Pollution Of Water Supply: In the event that contamination and/or pollution does occur to the village waterworks supply, the property owner and/or the customer responsible for allowing the contaminants and/or pollutants into the village waterworks system through an illegal cross connection or an improperly installed, maintained or repaired device, or a device which has been bypassed, shall bear all costs and expenses of decontamination of the village waterworks system.
