(A) Office Created: There is hereby created the office of village manager, an executive office of the village. Said village manager shall be appointed by the president, by and with the advice and consent of the board of trustees, and said employment shall be subject to the terms and conditions of an employment agreement entered into between said appointee and the corporate authorities, the terms of said agreement to take precedence over any other provisions contained in this code to the contrary. The village manager shall be the direct representative of the corporate authorities in the transaction of all village business and in all matters concerning the citizens of the village. (B) Bond: Before entering upon the duties of his office, the village manager shall take the oath of office required of the village officials as provided by statute, and shall give a bond in the amount of one million dollars ($1,000,000.00) for the faithful performance of the duties of the office. (A) It shall be the duty and responsibility of the village manager to supervise and coordinate the work of all the departments of the village government and to report directly to the president and board of trustees.
(B) As a representative of the corporate authorities of the village, the village manager shall have the power to direct or to stop any local improvement or public work being undertaken by the village if direction is required or if the work is being carried out in an improper manner. The village manager is to receive all complaints, suggestions, requests, applications, petitions and other correspondence or communications directed to the corporate authorities and wherever possible to adjust matters which do not require direct action of the corporate authorities. The village manager is responsible for the maintenance and upkeep of the village office complex and all village owned real estate.
(C) The village manager shall have the responsibility for the hiring and discharge of all village employees other than those under the board of fire and police commissioners or other tenure of office laws. (Ord. 577, 5-20-1975)
(D) As custodian of all funds of the village, the village manager shall have the following duties:
1. The village manager shall have custody of all village funds, which funds shall be deposited in such depository or depositories as are specified from time to time by the board, and shall perform such other duties as may be required by statute or ordinance.
2. The village manager shall not recognize nor pay any claim except upon a warrant or cash order drawn upon the village manager, signed by the president and countersigned by the village clerk, and stating the particular fund and the appropriation to which the warrant is chargeable and the person to whom payable. No money shall be paid by the village manager other than upon such warrants so drawn except as otherwise provided by ordinance.
All interest on village funds due from depositories or other sources shall be credited to the account of the village.
3. The village manager shall keep such books and accounts as may be required by the village board.
4. The village manager shall render monthly reports showing the state of the treasury at the termination of each month; and such other reports as may be required by ordinance, statute or the village board. (Ord. 86-1502, 12-1-1986, eff. 1-7-1987)
(E) The village manager shall be responsible for the overall management of budget expenditures for the budget year, keeping expenditures within budget as from time to time amended and as provided for in applicable state statutes. In addition, the village manager shall have the overall responsibility for all matters involving budgetary issues including, but not limited to, the overseeing of the budget preparation, budget amendments, budget changes, expenditures, revenues, etc. (Ord. 99-3118, 5-17-1999)
