§ 158.03 SUBDIVISIONS WITHIN VILLAGE LIMITS.
Before any final plat of any subdivision of an area within the bounds of the Village can be recorded, the final plat must be approved by the Village Board. The approval shall be evidenced by the signature of the Village President which shall in turn be attested to by the signature of the Village Clerk. The approval of the Village Board on any final plat can be secured only if the following procedure is adopted by the subdivider:
   (A)   Before any subdividing work has been commenced the subdivider (or his engineer) shall submit to the Village Board, the original drawing plus 3 copies thereof of a tentative plat of the proposed subdivision. The contents of this plat shall be prescribed under § 158.05 of this Chapter. At the same time, the subdivider shall submit to the Village Board the original drawing plus 3 copies thereof of a topographical map of the area included in the proposed subdivision. The contents of this map shall be as prescribed under § 158.06 of this Chapter. The Village Board, upon receipt of reports of both the Village Engineer and the Plan Commission shall weigh the facts and either approve or disapprove the tentative plat as it sees fit. The approval or disapproval shall be rendered within a period not to exceed the time between regular meetings of the Board. Approval shall be evidenced by the signature of the President and attested by the Clerk. Approval by the Village Board shall be evidence that the plat has likewise been approved by the Plan Commission.
   (B)   After the subdivider has received approval of his tentative plat he is at liberty to commence subdividing work. He shall have 1 year (from the date of approval of the tentative plat by the Village Board) in which to complete the subdivision work and any improvements as shall be required as pertinent to the subdivision by the Village Board. If the improvements required by the Village are not completed within the 1-year period allowed, a final plat may be approved by the Village Board only if a completion bond (in an amount equal to the cash value of the uncompleted portion of the work as established by an estimate prepared by a registered professional engineer) is furnished to the Board. A specimen of the proposed form of the bond is shown under § 158.17 of this Chapter. The final plat and 4 copies thereof shall be submitted to the Village Board before the expiration of the 1-year period. The final plat shall be prescribed under § 158.07 of this Chapter. Provided, however, that the period of 1 year provided for shall apply and be limited to subdivisions having an area not in excess of 50 acres; and for subdivisions having an area in excess of 50 acres the excess may be completed and finally approved and platted hereunder in contiguous parcels of 50 acres average thereof per year after the period of 1 year, until the total acreage of the subdivision shall have been finally approved and platted.
   (C)   The preliminary plat shall not be acted upon by the Village Board of Trustees until a filing fee therefor has been paid to the Village Clerk. The filing fee shall be in the amount set forth in the comprehensive fee schedule set forth in Section 12.02 of this code.
