(a) The City Council finds and determines that it is in the public interest and serves a public purpose to limit the maximum number of licenses that the City may issue as follows:
(2) Marihuana Retail establishments;
(2) Medical Marihuana Provisioning establishments;
(1) Marihuana Secured Transporter establishments;
(1) Marihuana Growing facility establishments;
(1) Marihuana Processing establishments; and
(1) Marihuana Safety Compliance facilities.
(b) In addition to the licenses issued pursuant to Section 853.07(a), the City may issue up to 4 additional Marihuana Processing establishment licenses and up to 4 additional Class A Marihuana Growing facility establishment licenses provided that those licenses be co-located with a Marihuana Retail establishment and/or Medical Marihuana Provisioning establishment.
(c) Should a license for a Marihuana Business become available due to expiration, revocation, or non-renewal, the City Clerk shall first contact any previous applicant that submitted a completed applicant in the ranking order established by the lottery. In the event that there are no qualified applicants, the City Clerk shall set an application period and receive new applications for a license(s) for a Marihuana Business over a fourteen (14) day period. At the end of the fourteen (14) day period, all properly submitted and complete applications shall be subject to examination and review by the City Council. The City Council may elect to issue or not issue licenses for any of the permitted uses or issue licenses in any combination thereof, but in no instance shall issue more licenses than are permitted pursuant to the terms of this Chapter.
