Upon receipt of an application as provided in Section 812.03, the Mayor and Council shall make or cause to be made such investigation as deemed necessary in regard thereto in order to determine that the proposed solicitation is in fact to be conducted for a charitable, educational, philanthropic or patriotic purpose. If the Mayor and Council are satisfied that the following conditions are upheld, the Mayor and Council shall make their grant of a permit and may include therein such conditions and limitations as they find necessary to fulfill the spirit and purpose of this chapter:
(a) That the cause for which such solicitation is to be made is in fact for a charitable, educational, philanthropic or patriotic purpose;
(b) That the proceeds derived from such solicitation will be used for such purpose;
(c) That such solicitation is not promoted or conducted primarily for private profit of its promoters;
(d) That from the information received as to the applicant and the solicitors, and also as to methods and means to be used in the solicitation, it appears unlikely that the people of the City will be cheated or defrauded;
(e) That the granting of a permit will not defeat the purpose of Council in requiring a permit;
That none of the operations of such activity is contrary to any ordinance, rule or regulation of the City;
(g) That such solicitation will not use a charity or patriotic appeal as a means of selling private merchandise or promoting personal or commercial interests; and
(h) That such solicitation and the methods used in the conduct thereof will not be incompatible with the protection of the health, life and property of the residents of the City.
