244.281   SALARY FOR MAYORAL STAFF APPOINTEES.
   (a)   Mayoral staff appointees are unclassified employees and shall mean the persons holding one of the following positions:
      (1)   Chief of Staff;
      (2)   Finance Director;
         (a)   Deputy Finance Director, known as the Project Performance / Cost Compliance Manager;
      (3)   Utilities Director;
         (a)   Deputy Utilities Director;
      (4)   Public Works Director;
         (a)   Deputy Public Works Director (Parks);
         (b)   Deputy Public Works Director (Streets);
      (5)   Housing and Neighborhoods Director;
         (a)   Housing and Neighborhoods Deputy Director;
      (6)   Workforce and Small Business Development Director, known as the Workforce and Small Business Development Coordinator;
      (7)   Human Resource Director;
      (8)    Communications Director, known as the Public Information Officer;
      (9)   Secretary to the Mayor.
   (b)   Existing Appointees. An existing appointee is any person who had been appointed prior to passage of Ordinance 93-22 to a position listed in subsection (a) above (or the precursor position; e.g. Director of Community Development), and who continues to serve in that position (or in any other position listed in subsection (a) above) after passage of ordinance 93-22, enacting this Section 244.281.
      (1)   Existing Appointee Pay to Continue. After passage of this ordinance, all existing appointees shall continue to receive the same pay they were entitled to receive prior to passage of ordinance 93-22, enacting this Section 244.281.
   (c)   New Appointee Maximum Starting Salary. After passage of ordinance 93-22, a person newly appointed to one of the positions listed in subsection (a) above shall be paid at an amount determined by the Mayor but not to exceed ninety percent (90%) of the annualized ending pay of the previous appointee in that position, except as may be authorized by separate Ordinance of Council.
      (1)   The Director of Community Development position shall be considered to be the previous appointee position for the Director of Housing and Neighborhoods position.
   (d)   Effective January 1 of each calendar year after passage of Ordinance 93-22, the persons occupying a position set forth in subsection (a) above, except for the position of Secretary to the Mayor, shall receive a Cost of Living Adjustment (COLA) in salary above the previous year's annualized salary, as set forth as follows:
      (1)   Beginning January 1, 2023, and effective January 1 of each year thereafter, the salary of each respective official set forth in subsection (a) above shall be increased by the same percentage as the Consumer Price Index for All Urban Consumers (CPI-U) reported by the U.S. Bureau of Labor Statistics for the 12 month period ending through the month of October preceding the effective date of the annual adjustment (the October CPI-U). For example, for a Cost of Living Adjustment to be granted under this section and scheduled to begin January 1, 2023, the CPI-U reported for the 12 month period ending through October 2022 (the October CPI-U) shall be the CPI-U used to calculate a salary adjustment.
         A.   Regardless of the reported October CPI-U, in no event shall a COLA granted under this section exceed 3%.
         B.   In the event the reported October CPI-U is a zero or a negative number, then no COLA shall be granted for that respective year.
   (e)   In addition, each individual holding a position named in subsection (a) above is eligible to receive annual merit increases in pay as may be approved by the Mayor not to exceed a 2% increase per person. The Mayor shall notify Council, in writing by December 15 of each year, of the merit increases approved. Any such merit increase shall be effective January 1 of the following year, subject to further Council action if any. A motion to review any merit increase given by the Mayor shall require an affirmative vote of two-thirds of the members elected to Council. A motion to change any merit increase given by the Mayor shall require an affirmative vote of two-thirds of the members elected to Council.
   (f)   The City shall also pay the premiums for policies of term life insurance on the persons holding the positions listed in subsection (a) above, for a face amount of $100,000.00. The Director of Human Resources and the Finance Director shall determine the appropriate Insurance Company or Companies licensed and authorized to do business in the State of Ohio from which to obtain the policy or policies of insurance, in accordance with the City Purchasing Policy, City Code Section 228.07. The Mayor is authorized to enter into such contracts as may be necessary to effectuate this provision.
   (g)   The persons holding the following positions shall also be paid at the end of each month the amount of $180.00 as a standardized mileage allowance for travel associated with City business in their personal motor vehicles: Chief of Staff; Housing and Neighborhoods Director; Finance Director; Human Resource Director; Workforce and Small Business Director; Communications Director; Housing and Neighborhoods Deputy Director.
   (h)   The Secretary to the Mayor specifically, shall receive annual wage increases from year to year in the same percentage as is granted to union members covered by the Collective Bargaining Agreement with the American Federation of State, County and Municipal Employees, Ohio Council 8, Local 1002, AFL-CIO, as may then be effective.
      (1)   The Secretary to the Mayor shall also be eligible to receive a merit increase as set forth in subsection (e) above; life insurance coverage as set forth in subsection (f) above; economic benefits as set forth in subsection (i) below; but not the COLA in subsection (d) above.
   (i)   In addition to the salary and benefit provisions provided in this city code section, and the maximum starting salary under (c) above, and in addition to any other ordinance establishing pay raises or benefits for such positions, an employee holding a position in subsection (a) of this section shall receive those same economic benefits as are set forth in the effective Agreement with the American Federation of State, County and Municipal Employees, Ohio Council 8, Local 1002, AFL-CIO, except for the provisions referring to work time, discipline and discharge, and benefits specifically relating to union representation. The Mayor is authorized to issue a directive or policy providing for different economic benefits for any of the positions in subsection (a) above; provided that such directive or policy may not authorize any additional base salary for such positions higher than as established through council ordinance.
