(a) An employee appointed as an Arson Investigator in the Fire Department shall have the duty to conserve the peace and enforce all laws within the City and shall have the authority to arrest violators of the ordinances of the City and the laws of the State, within the City, and to serve summonses, warrants and all other legal writs and processes. The appropriate peace officer's training, as determined by the Ohio Peace Officer's Training Council, shall be required for this position.
(b) The Arson Investigator is permitted to carry a firearm while acting in the capacity of an arson investigator. In order to carry a firearm, as referenced herein, the arson investigators shall meet annual qualification requirements described in Ohio Revised Code 109.801 and shall complete, at a minimum, training in the use of firearms, arrest techniques, and use of force.
(c) It shall be within the power and sole discretion of the Fire Chief to provide for any additional qualifications or requirements for an Arson Investigator to carry a firearm, and to suspend or revoke an Arson Investigator’s ability to carry a firearm while on duty with the Lima Fire Department.
(d) The Arson Investigator is hereby also authorized to prevent noise and disturbance and indecent and disorderly conduct, preserve the peace and good order and protect the property of the City beyond the geographic limits of the City on property owned by the City, pursuant to Ohio R.C. 715.49 and 715.50.
