234.09   EMERGENCY FIRE PROTECTION TO OUTSIDE AREAS NOT COVERED BY CONTRACT.
   Pursuant to the authority granted by Ohio R.C. 9.60, the services of the Fire Department and the use of its fire apparatus and personnel may be extended beyond the corporate limits to areas not covered by special contracts for fire protection or by contracts for mutual aid if the following conditions are met:
   (A)   The dispatching of the personnel and equipment of the Fire Department to areas not covered by contract may be made in the event of a public disaster, catastrophe, general conflagration or extreme emergency.
   (B)   The dispatching of the equipment and personnel of the Fire Department to the scene of the fire shall be made only upon the authority of the Fire Chief or of the officer in charge of the Department at the time thereof and shall be made only when consistent with the proper protection of the City, as determined by such officer and upon a finding by such officer that such action is justified.
