(a) At and during the Lewisburg Annual Derby Days Festival held on a three day period in August of each calendar year (as sanctioned by Council), a portion of the downtown area public streets and public right-of-ways will be blocked off for normal vehicular traffic and be open for the public for festival activities.
(b) The Mayor and/or Chief of Police may review and approve any plan of a community group to operate said Festival, including a layout of activity, vendor, and other booths designed for purposes of public health, safety, morals, and welfare, including but not exclusive of other matters:
(1) Organized layout for esthetics, accessibility, and crowd control.
(2) Prevention of conglomerate groups of people around roaming vendors and solicitors.
(c) No person shall sell goods, merchandise, and/or medicines in the public streets and public right-of-ways in the downtown Derby Days Festival area during the Derby Days Festival, unless they are doing so in an approved booth area and after paying any required booth fee to a community group sponsoring the Derby Days Festival.
(d) No community group sponsoring the Derby Days Festival shall prohibit anyone from obtaining an approved booth area due to geographic limitations, unless Council so approves on a first applied for/first approved basis.
(e) Anyone violating subsection (c) hereof shall be guilty of a minor misdemeanor, and if they refuse to abate their conduct, subject to arrest. (Ord. 2001-13. Passed 7-19-01.)
