133.10 COMPETITIVE BIDDING ON CONTRACTS.
   (a)   Contracts exempt from competitive bidding requirements under the Village Charter shall remain exempt per Charter procedure. Council and/or the Municipal Manager may still seek estimates, quotes, or other information prior to entering into a contract exempt from competitive bidding requirements.
   (b)   All other contracts in which the estimated expenditure of Village funds is to exceed thirty-five thousand dollars ($35,000) shall require the solicitation and review of formal written competitive bids after at least one advertisement in at least one newspaper of general circulation in Preble County, Ohio, noticing the following:
      (1)   A general description of the contemplated contract.
      (2)   A date, time and place for an opening of all sealed bids.
      (3)   A statement of where the bids need to be sent and where bid specifications and document requirements can be obtained.
      (4)   An award clause stating that the contract will be awarded to the lowest and best bidder, as determined by the Municipal Manager and per Village Charter procedural requirements.
      (5)   A reservation clause allowing the Village to accept or reject any and all bids.
   (c)   All other contracts in which the estimated expenditure of Village funds is to be thirty-five thousand dollars ($35,000) or less shall be exempt from competitive bidding requirements. Council and/or the Municipal Manager may still seek estimates, quotes, or other information prior to entering into a contract exempt from competitive bidding requirements.
   (d)   Council always reserves the right to use competitive bidding on any contract, and if required as a condition to obtain a grant and/or loan, under potentially different competitive bidding rules per said grant and/or loan requirements.
   (e)   No contract of the Village of Lewisburg, Ohio, shall be void or voidable simply due to a failure to follow or meet the detailed provisions of this section.
