103.02 MINIMUM INSURANCE FOR CONSTRUCTION CONTRACTS.
   (a)   To shield the Village, from potential liability resulting from work done within the Village by construction firms the Village has contracted with, such construction firms shall be required to carry and provide the Village a copy of proof of the following minimum insurance coverage, over and above any regular bond requirements:
      (1)   Liability coverage for personal injury and property damage caused by its owners, employees, equipment, vehicles, construction sites, and other property and activities, in the minimum amount of one million dollars ($1,000,000) per incident.
      (2)   Medical payments, irrespective of fault, in the amount of twelve thousand five hundred dollars ($12,500) per person and twenty-five thousand dollars ($25,000) per incident.
   (b)   Such construction firms shall agree to hold the Village, harmless from such firms activities and shall defend any actions brought against the Village, by any legal entity or person damaged as a result of the construction activities engaged in by the contractors.
   (c)   For good cause shown, and upon the application of a potential construction contractor, Council, may waive the requirements of this section, when the advantages of requiring insurance coverage are outweighed by the cost factor and the degree of potential risk to persons and property.
