(A) There is hereby created a Board of Zoning Appeals consisting of five members who shall hold no other office or position of employment with the Municipality. The members of the Board of Zoning Appeals shall be appointed by the Council by the adoption of a motion by a majority vote of its members and shall serve for five year terms of office; however, the first members appointed under this Charter shall be appointed so that one shall serve for a term of five years, one shall serve for a term of four years, one shall serve for a term of three years, one shall serve for a term of two years and one shall serve for a term of one year. Thereafter, all members shall serve for a term of five years.
(B) The Board of Zoning Appeals shall have those powers, duties, and functions as provided by this Charter and as provided by the ordinances and resolutions of the Municipality.
