10-2-3: AUTHORITY HAVING JURISDICTION:
   A.   Whenever there are practical difficulties involved in carrying out the provisions of any of the codes adopted in section 10-2-1 of this chapter, the authority having jurisdiction ("AHJ") has ultimate responsibility to administer the respective code section and shall have the authority to grant modifications for individual cases. The obligation to justify such a modification is on the owner, who shall apply in writing and state: 1) the specific reason the strict application of the code is impractical; 2) the requested modification; and 3) the reason that granting the modification still meets the intent and purpose of the specific code section and does not lessen the health, life or fire safety requirements. The owner shall also supply any supporting documentation, reports or other data necessary for the AHJ to make a determination. The AHJ shall have the right to consult with other City employees and, if necessary, outside professionals in order to render an informed decision. The AHJ shall render a written decision within thirty (30) days of receiving the information described above. If the AHJ determines that more time is necessary to render a decision, the AHJ shall inform the owner of such and how much additional time will be necessary.
   B.   The AHJ for each of the codes listed in section 10-2-1 of this chapter shall be as follows:
      1.   International Building Code: Assistant Building Official.
      2.   International Property Maintenance Code: Assistant Building Official.
      3.   International Residential Code: Assistant Building Official.
      4.   International Fire Code: Fire Marshal.
      5.   International Wildland-Urban Interface Code: Fire Marshal.
      6.   International Plumbing Code: Assistant Building Official.
      7.   International Mechanical Code: Assistant Building Official.
      8.   National Electrical Code: Assistant Building Official.
      9.   National Electric Safety Code: Power Department Operations Manager.
      10.   International Fuel Gas Code: Assistant Building Official.
