ADOPTING ORDINANCE
ORDINANCE NO. 51-2015
AN ORDINANCE ADOPTING AMENDMENTS TO THE LEHI CITY CODE
WHEREAS, over time various provisions of the Lehi City Code (the "Code") have become out of date, duplicative of Utah State Code, or in some instances, in direct conflict with Utah State Code; and
WHEREAS, in an effort to update the Code and to resolve issues of conflict described above, revisions have been made to various sections and chapters of the Code, including the deletion of entire sections where necessary; and
WHEREAS, on March 3, 2015, April 14, 2015, June 2, 2015, and October 6, 2015, the Lehi City Council reviewed the proposed changes to the Code and on October 13, 2015, the Lehi City Council held a duly-noticed public meeting to receive public comment and ascertain the facts regarding this matter, which facts and comments are found in the meeting record; and,
WHEREAS, after considering the facts and comments presented to the Lehi City Council, the Council finds: (i) the Lehi City Code should be amended as shown on the attached Exhibit "A"; and (ii) such action furthers the health, safety and welfare of the citizens of Lehi City.
NOW, THEREFORE, BE IT ORDAINED by the Lehi City Council, as follows:
PART I:
The Lehi City Code is hereby amended as shown in Exhibit "A".
PART II:
A. If a provision of this Ordinance 51-2015 conflicts with a provision of a previously adopted ordinance concerning the same title, chapter, and/or section number amended herein, the provision in this Ordinance shall prevail.
B. This ordinance and its various section, clauses and paragraphs are hereby declared to be severable. If any part, sentence, clause or phrase is adjudged to be unconstitutional or invalid, the remainder shall not be affected thereby.
C. The Lehi City Council hereby directs that the official copy of the Lehi City Code be updated to reflect the provisions enacted by this Ordinance.
D. This Ordinance shall take effect immediately after being posted or published as required by law.
