ADOPTING ORDINANCE
ORDINANCE NO. 7191
ORDINANCE REVISING, AMENDING, RESTATING, CODIFYING, AND COMPILING THE LEBANON CODIFIED ORDINANCES
   WHEREAS, the present Lebanon Codified Ordinances are incomplete and inadequate and the manner of classification and indexing thereof is insufficient to meet the immediate needs of the City; and
   WHEREAS, the Ohio Revised Code authorizes the City to revise, amend, restate, codify and to compile its ordinances and to incorporate the ordinances into one ordinance in book form; and
   WHEREAS, this Council has authorized a compilation, revision and codification of the ordinances of the City of a general and permanent nature and the publication of the ordinances in book form.
   WHEREAS, this Ordinance supersedes and replaces Ordinance No. 6874 which was read but not enacted; and
   NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LEBANON, OHIO:
   Section 1.   The Lebanon Codified Ordinances as herein revised, amended, restated, codified, and compiled in book form are adopted as and shall constitute the "Code of Ordinances of the City of Lebanon, Ohio" (the "Code").
   Section 2.   The Code as adopted herein shall consist of the following parts and titles, to-wit:

   Section 3. All prior ordinances pertaining to the subjects treated in the Code are repealed from and after the effective date of this Ordinance except as they are included and reordained in whole or in part in the Code; provided such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of the Code, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, naming or vacating or setting the boundaries of streets, alleys or other public places, nor to any other ordinance of a temporary or special nature or pertaining to subjects not contained therein.
   Section 4.   The Code shall be deemed published as of the day of its adoption and approval by this Council and the Clerk is hereby authorized and ordered to file a copy of the Code in the Office of the Clerk.
   Section 5.   The Code shall be in full force and effect upon the effective date of adoption of this Ordinance, its publication and filing thereof in the Office of the Clerk, and the Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded and approved and that any public hearings and notices thereof as required law have been given.
   Section 6.   This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety, welfare, and morals of the City of Ohio, and for the further reason that the ordinances of the City of Lebanon are in immediate need of proper classification and indexing then this Ordinance shall take effect immediately upon its adoption.
