§ 92.116  APPLICATION FOR PERMIT; ACCOMPANYING BOND.
   Before the Common Council shall grant any permit, as provided in § 92.115, the person applying for the permit shall file with the City Clerk-Treasurer his or her application for the permit, in which he or she shall particularly describe the route over which the house, barn, shed or other building is to be moved, along with his or her bond in the sum of $5,000, conditioned that the person shall indemnify and same harmless the city and all persons from any and all damages, costs and expenses that may accrue by reason of the moving of the house, barn, shed or other building. The bond shall be signed by two resident freeholders of this county, or by any trust or bonding company operating under the laws of the state. The bond shall be approved or disapproved by the Common Council of the city, on the next meeting night of the Common Council, either regular or special, after the filing of the petition and the bond.

§ 92.117  NOTICE TO MOVE WIRES; MOVING OF WIRES.
   Before any person owning the same shall move any house, barn, shed or other building over the streets, alleys, bridges or thoroughfares of the city, he or she shall give five days’ notice to any person having wires crossing the streets, alleys, bridges or thoroughfares of the city and likely to be affected by the moving of the house, barn, shed or other building, and upon receipt of the notice any person having wires crossing the streets, alleys, bridges or thoroughfares of the city and likely to be affected as aforesaid, shall move the wires in a manner as to permit the moving of the house, barn, shed or other building.

UNSAFE BUILDINGS
§ 92.130  UNSAFE BUILDING LAW ESTABLISHED.
   Under the provisions of I.C. 36-7-9, there is hereby established the City Unsafe Building Law, and by and through its Planning and Zoning Administration Department (PZA Department), the City Executive is designated to enforce the terms thereof.

§ 92.131  STATE LAWS ADOPTED.
   I.C. 36-7-7-1 through 36-7-9-28, is hereby adopted by reference as the Lebanon Unsafe Building Law. All proceedings within the city for the inspection, repair and removal of unsafe buildings shall be governed by the aforementioned law and the provisions of this subchapter. In the event the provisions of this subchapter conflict with the provisions of I.C. 36-7-9-1 through 36-7-9-28, then the provisions of the state statute shall be controlling.

§ 92.132  PUBLIC NUISANCE DECLARED.
   All buildings or portions thereof within the city which are determined after inspection by the Building Inspector to be unsafe, as defined in this subchapter, are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal.

§ 92.133  ORDERING REPAIR OR REMOVAL OF UNSAFE BUILDINGS.
   The Building Inspector, as chief administrative officer of the Department of Planning and Development, or his or her designated representative, shall be authorized to administer and proceed under the provisions of the law in ordering the repair or removal of any buildings found to be unsafe as specified therein or as specified hereinafter.
