§ 90.99 PENALTY.
   (A)   Any violation of a provision of §§ 90.01 through 90.26 of this chapter is hereby classified as a civil offense pursuant to KRS 65.8808 and nothing contained herein or in §§ 39.01 et seq. shall prohibit the enforcement of this chapter by any other means authorized by law.
   (B)   Any person who violates any provision of §§ 90.02 or 90.05 shall be fined not more than ten dollars ($10) if the violation is not contested and not more than twenty dollars ($20) if the violation is contested for each offense. Each day the violation exists shall constitute a separate offense.
   (C)   Any person who violates § 90.03 shall be fined not more than two hundred fifty dollars ($250) if the violation is not contested and not more than five hundred dollars ($500) if the violation is contested.
   (D)   Any person who violates § 90.04 shall be fined not less than fifty dollars ($50) nor more than two hundred fifty dollars ($250) if the violation is not contested and not less than one hundred dollars ($100) nor more than five hundred dollars ($500) if the violation is contested.
   (E)   Any person who violates any of the provisions of §§ 90.15 through 90.19 shall be fined not less than five dollars ($5) nor more than twelve dollars and fifty cents ($12.50) if the violation is not contested and not less than ten dollars ($10) nor more than twenty-five dollars ($25) if the violation is contested for each offense. Each day the violation continues shall constitute a separate offense.
   (F)   Any owner found violating any provision of § 90.23 shall be punished by a fine of not less than five dollars ($5), nor more than fifty dollars ($50) if the violation is not contested and not less than ten dollars ($10) nor more than one hundred dollars ($100) if the violation is contested for such offense.

   (G)   Whoever violates any provision §§ 90.01 through 90.26 of this chapter for which another fine is not already provided shall be fined not more then fifty dollars ($50) if the violation is not contested and not more than one hundred dollars ($100) if the violation is contested.
   (H)   Any owner violating divisions (A), (B), (D)(1), (E), or (F) of § 90.33 shall be punished by a fine of two hundred fifty dollars ($250).
   (I)   Any owner violating divisions (C) or (E) of § 90.33 shall be punished by a fine of one thousand dollars ($1,000) and up to six (6) months in prison.
   (J)   Any owner violating divisions (D)(2) or (3) of § 90.33 shall be punished by a fine of one hundred dollars ($100).
   (K)   Any owner violating § 90.40 shall be punished by a fine of one hundred dollars ($100). Each day the violation continues shall constitute a separate offense.
   (L)   All penalties assessed pursuant to this section shall be in addition to any charges incurred by the owner under § 90.22 of this chapter.
   (M)   Any owner violating § 90.45 shall be punished by a fine of not less than five dollars ($5) nor more than twenty-five dollars ($25) for each violation of that section. Each incident as described in § 90.45(B) shall constitute a separate offense.
