§ 5-2-6-41. ACCOMMODATION OF RUNOFF.
   A storm water facility shall be provided which allows drainage of water runoff from each upper watershed area and from each portion of the parcel to a place or places adequate to receive it. The part of the storm water facility situated within the parcel, in addition to complying with the requirements stated under § 5-2-6-40:
   (A)   Shall drain adequately each and every part of the parcel;
   (B)   Shall be sufficient to accept the present water runoff from developed and undeveloped areas upstream.
      (1)   The part of the water runoff attributable to future development in undeveloped or underdeveloped areas upstream, which is not reasonably likely to be accommodated in such upstream areas shall also be accommodated; and
      (2)   At least one opening shall be provided for each watershed at the upstream edge of the parcel or adjacent properties to accept upstream drainage.
   (C)   May include consideration of improvements such as retention-detention systems in the instance where the condition of the land makes use of such improvements feasible and appropriate; and
   (D)   Shall be sized and proportioned in accordance with design criteria found in regulations promulgated under § 5-2-6-37.
