§ 5-2-6-40. CHARACTERISTICS OF STORM WATER FACILITIES.
   The storm water facility shall:
   (A)   Be capable of accommodating the required design intensity of a rainfall, as specified in regulations promulgated under § 5-2-6-37, without endangering the public safety and health, or causing damage to property;
   (B)   Be safe to persons, durable, easy to maintain;
   (C)   Retard erosion and sedimentation; and
   (D)   Provide water quality benefit in compliance with the provisions of this chapter.
