5-2-23: PENALTY:

   A.   Misdemeanor: Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor.

   B.   Separate Offense: Each day violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such under this chapter. (Ord. 1993-7, 12-9-1993)

   C.   Violation Of Specific Sections: For violation of sections 5-2-7, 5-2-10, 5-2-11 and 5-2-12 of this chapter, the penalty shall be as hereinafter set forth:

      1.   The owner or custodian of an animal shall be issued a notice of violation and assessed a fee of fifty dollars ($50.00) per occurrence to be collected by the Lava Hot Springs city office.

      2.   The fee shall increase to sixty two dollars fifty cents ($62.50) if it remains unpaid for a period of ten (10) days.

      3.   Each day that the violation continues shall constitute a separate offense.

      4.   The fee shall be independent of any criminal penalties imposed by any court having jurisdiction due to misdemeanor prosecution.

      5.   If the owner of the animal is a minor, the head of the household in which the minor resides shall pay any fees, fines or other penalties as may be imposed by a court having jurisdiction. (Ord. 2015-6, 5-14-2015)
