§ 111.61  REGULATIONS.
   A purpose of this subchapter is and remains to further restrict and further regulate on a rational, reasonable basis, the locations within which mobile food vendors shall be allowed to locate and operate their respective businesses subject to the fees required within the City of LaSalle ordinances as well:
   (A)   No such mobile food vendor as defined in § 111.60 shall remain stationary for in excess of 15 minutes on any public or private property, within the city, except as follows, and further except as may be otherwise allowed under other provisions of other LaSalle ordinances:
      (1)   Mobile food vendors shall be allowed to operate and be located at private parties defined as provided within this subchapter and subject to obtaining authorization therefor as otherwise provided within this subchapter, and at special events also defined as provided within this subchapter; subject to the provision that any special event not sponsored by the city shall be subject to being authorized by the city through the joint approval of the Economic Development Director and the Mayor; further, in the event that said parties are not able to agree and/or in the event the Mayor and the Director of Economic Development deem it within the appropriate exercise of discretion to be a matter that should be considered by the City Council, then the permit application shall be considered by the City Council as a whole.
      (2)   On such other locations within M-1 zoning of the city after first having obtained a special use permit, but only after filing for, and being granted a special use permit, after following appropriate procedures of the city ordinances, following appropriate hearings in connection therewith before the Planning Commission and then consideration by the City Council.
      (3)   (a)   Mobile food vendors working with brick and mortar businesses outside of Central Business District. In areas other than the “Central Business District,” which for purposes of this division (A)(3)(a) is defined as from east to west to be from the location of the railroad on the east, to the location of the railroad on the west, and from north to south, to be from the north side of Third Street to the south side of First Street inclusive, other than within said Central Business District, mobile food vendors are hereby allowed to remain stationary for in excess of 15 minutes and operate in such other areas within the city for up to 12 times per year at any given location provided the mobile food vendor has a written agreement with a specific brick and mortar business, and further provided that said brick and mortar business location shall not have a mobile food vendor located at said premises more than 12 times in a given fiscal year (May 1 through April 30). Any mobile food vendor authorized to conduct business at any such location must be licensed by the city pursuant to provisions of the City of LaSalle ordinances and have a permit for operation at the specific location for the date of each specific event.
         (b)   Mobile food vendors working with non-profit businesses outside of Central Business District. The regulation of the location and manner of operation of mobile food vendors is further reasonably and rationally regulated to provide that mobile food vendors shall additionally be allowed to remain stationary for in excess of 15 minutes on any public or private property not within the “Central Business District” (from east to west to be from the location of the railroad on the east, to the location of the railroad on the west, and from north to south, from the north side of Third Street to the south side of First Street inclusive within the city). Mobile food vendors shall be allowed to remain stationary for in excess of 15 minutes and to operate at the location of a non-profit organization, provided that the non-profit organization is outside the Central Business District as aforesaid. Any mobile food vendor operating at any such location authorized by this division (A)(3)(b) shall be required to have a city mobile food vendor license and to have obtained a permit regarding operation as a mobile food vendor at the particular location for said date, all as provided in regard to licensing and permit requirements as provided within this subchapter and other ordinances of the city.
   (B)   The fees and provisions in regard to permitting such mobile food vendors are and shall remain as provided within the other sections of this chapter.
   (C)   Notwithstanding anything else contained in this subchapter to the contrary, this subchapter shall not in any manner affect any presently existing mobile food vendor right to continue to operate in the present location where any such business may presently be operating; except that the requirements to obtain and pay for a permit shall apply to any such presently existing mobile food vendor commencing with fiscal year beginning May 1, 2019.
