For the purposes of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BRICK AND MORTAR BUSINESS. A business lawfully operating at a fixed location within a building within the city.
MOBILE FOOD VENDOR. Any person or company traveling from place to place upon public highways utilizing a vehicle licensed to operate on public roads by the State of Illinois and within the city that sells any food items, whether cold, frozen, hot or otherwise; and or intending to operate from a fixed location on private or public property.
PRIVATE PARTY. An event wherein an individual, a group, and/or an entity which may or may not be a business (hereinafter the “private party applicant”) pays a fee and/or wherein members and/or participants in the private party would individually pay a mobile food vendor to provide food at a private event, similar to such as a caterer would do in regard to provision of food except that the food may be prepared on premises. This could occur on private property, and/or on city streets and other city property such as a park involving a mobile food vendor that has been licensed by the city as provided within City of LaSalle ordinances. This is also subject to a permit therefor having been authorized by the city through the joint approval of the Economic Development Director and the Mayor; further, in the event that said parties are not able to agree and/or in the event the Mayor and the Director of Economic Development deem it within the appropriate exercise of discretion to be a matter that should be considered by the City Council, then the permit application shall be considered by the City Council as a whole. In regard to any PRIVATE PARTY, a mobile food vendor shall not be allowed to sell and/or otherwise provide food to the general public.
SPECIAL EVENT. An event within the city that is sponsored by the City of LaSalle and/or the LaSalle Business Association, and/or another event wherein 75 or more people are anticipated to be in attendance, such as in regard to a block party, and/or otherwise wherein the event is publicized by the city, and/or is authorized by the City Council to have the closure of streets. Events at the Carus Mansion, specifically sponsored and/or specifically authorized by the proprietors of the Carus Mansion are also considered a preexisting authorized SPECIAL EVENT, but in regard to Carus Mansion special events, mobile food vendors will be required to meet the licensing and permit fee provisions of this subchapter. Mobile food vendors at special events are allowed to sell food to the general public. All mobile food vendors participating in non-city of LaSalle and/or LaSalle Business Association special events must be licensed by the city and have a permit issued by the city in regard to the special event as provided within this subchapter and other ordinances of the city. Mobile food vendors participating in City of LaSalle and/or LaSalle Business Association sponsored events need only pay the event fee and meet the registration requirements of that particular special event.
