§ 70.25  DEFINITIONS.
   Unless the context clearly indicates otherwise, the words, combinations of words, terms, and phrases, used in this subchapter shall have the meanings set forth as follows:
   ALL-TERRAIN VEHICLE or ATV.  A motorized flotation tired vehicle of not less than three low pressure tires, but not more than six tires, that is limited in engine displacement of less than 1600 cubic centimeters and total dry weight less than 1200 pounds.
   COMPLAINANT.  Includes any officer of the Landis Police Department who makes personal observation of prohibited activities or any person who either owns, rents, possesses a lot as defined and subject to this subchapter which is adversely effected.
   ESTABLISHED RIDING AREA.  Trails or area on a lot used by the operator of a motorized dirt bike and/or ATV.
   LOT or LOTS.  A lot which is part of an approved subdivision, the map of which has been recorded with Rowan County Register of Deeds, or a lawful lot described by metes and bounds, the deed of which has been recorded with the Rowan County Register of Deeds, or one for which the town has granted a waiver from platting.
   MOTORIZED DIRT BIKE.  A two-wheeled vehicle being capable of cross-country travel on natural terrain without benefit of a road or trail.
   OWNER.  Includes any person or entity as established in accordance with the land records as maintained by the Rowan County Register of Deeds office, or persons in legal possession of the property in question.
   PUBLIC RIGHT-OF-WAY.  Includes any street or other public and/or private right-of-way as established by either (a) a governmental entity, (b) private individual or corporate entity pursuant to a plat or survey, the same being recorded in the Rowan County Register of Deeds office. For the purpose of this subchapter, it shall not be necessary to show that the Town of Landis has previously accepted the same.
