10-9-1: ESTABLISHMENT OF FEES AND COSTS:
The President and Board of Trustees of the Village have determined that it is appropriate and in the best interests of the Village and its residents to adopt standards related to fees for building, engineering, and public works review of development applications, as provided in this section. Therefore, be it ordained by the President and Board of Trustees of the Village that fees and costs for the applications and reviews shall hereby be pursuant to title 13, chapter 1, "Fee Schedule", of this Code.    A.   Consultant Fees: When payment of consultant fees is required, the applicant shall pay all outside consultant fees including Village Attorney fees incurred by the Village during review of the application.
Each applicant for multi-family or nonresidential development shall pay to the Village an amount determined by the Code official to be set up as an escrow account to pay for review fees other than engineering fees.
If amounts for reviews exceed the balance in the escrow account the developer will be required to reimburse the account upon notice from the Village.
If, following final development completion, there is a balance remaining in the escrow account, the applicant will be refunded the reconciled amount without interest, upon his request.
If, after one year from final development completion date, no request has been received, the remaining balance will not be available for refund.
   B.   Engineering, Planning, And Public Works Review Fees: The applicant shall pay the engineering, planning, and public works review and inspection fees pursuant to title 13, chapter 1, "Fee Schedule", of this Code. For purposes of this subsection, the phrase "estimated costs of site development" shall mean the sum of all costs estimated to be incurred to complete development of the project as proposed, including, without limitation, the costs of all required public improvements, site development, parking facilities, utilities, landscaping, and the like, but not including costs of construction of buildings, all as determined by the Village Engineer.
   C.   Fees For Additional Notices And Hearings: If any application requires one or more public hearings, with public notice, in addition to the first public hearing, then the applicant shall pay all costs incurred by the Village in making the required public notice for each such additional public hearing and shall pay all costs incurred by the Village for court reporting services and other such administrative costs.
   D.   Recording And Filing Fees: The applicant shall pay all recording and filing fees applicable to the application.
   E.   Multiple Forms Of Relief: Whenever an application seeks more than one form of relief, then the applicant shall pay all fees associated with each form of relief, as provided herein.
   F.   Fees Cumulative: All fees provided herein are cumulative.
   G.   Payment Required Before Application Processed Or Approved: No application shall be processed, and no approval shall be made, until all applicable fees provided in this section have been paid in full. (Ord. 2003-02-219, 2-18-2003; amd. Ord. 2018-12-279, 12-3-2018)
