10-6-1: ENGINEERING STANDARDS AND SPECIFICATIONS:
The village engineer shall develop, maintain and, from time to time, amend a "village of Lake Zurich engineering standards and specifications" for the design and installation of public improvements in the community. These standards and specifications are incorporated herein and are made a part of this code by such reference.
   ENGINEERING AND LAND IMPROVEMENTS:
   STANDARDS AND SPECIFICATIONS
   A.   Intent: The following is the intent of the engineering and land improvement standards and specifications of the village:
      1.   Provide for a safe, healthy and pleasant environment.
      2.   To maintain high property values.
      3.   To ensure for high quality and long lasting improvements to the land.
   B.   Standards And Specifications: These standards and specifications shall apply to all construction activities within the jurisdiction of the village to within five feet (5') of any building or structure falling under the village building department.
   C.   Documents: The following documents are included by reference in these standards and specifications. The revision or edition in effect at the time of preliminary plan approval shall apply for a given development.
      1.   "Standard Specifications For Road And Bridge Construction" by Illinois department of transportation.
      2.   "Standard Specifications For Traffic Control Items" by Illinois department of transportation.
      3.   "Supplemental Specifications And Recurring Special Provisions" by Illinois department of transportation.
      4.   "Design Manual" by Illinois department of transportation.
      5.   "Standard Specifications For Water And Sewer Main Construction In Illinois" by Illinois Society Of Professional Engineers, et al.
      6.   "Standard Specifications For Sanitary And Water Service Connections" by Lake County department of public works.
      7.   Other standards or specifications specifically referred to in an individual provision of these standards and specifications.
      8.   All documents cited in the above standards and specifications relevant to the subject under consideration. If a conflict arises between any provision(s) of the referenced items above and any provision(s) of these standards and specifications, then the more restrictive provision(s) shall apply.
   D.   Contractor May Discharge Duties: Many of the obligations of the developer or owner found in these standards and specifications are more properly discharged by the contractor. Provisions pertaining to the construction and warranty phases of a development with the phrase "developer or owner" or "developer or owner or contractor", in whatever order, shall be taken to be equivalent to the phrase "developer and/or owner and/or contractor".
The intent of this provision is to ensure that the parties to the contract are jointly and individually obligated to meet the construction, warranty and maintenance requirements of the village. It is the intent of this provision that the village not be burdened with tasks required of one of the contracting parties who has abandoned his responsibilities.
   E.   Alternate Methods Or Materials:
      1.   Where provisions of these standards and specifications are impractical or extraordinarily costly to implement because of site conditions, the village engineer may vary or modify the provisions in question at the request of the developer or owner; provided, that the intent of these standards and specifications is not violated.
      2.   Materials or methods not specifically prescribed in these standards and specifications may be used at the discretion of the village engineer based on the intent of these standards and specifications.
      3.   The developer or owner shall provide the village engineer technical data and reports as deemed necessary by the village engineer to assist the village engineer in reaching a decision concerning the acceptability of proposed variations or modifications of provisions of these standards and specifications, or the acceptability of proposed nonprescribed materials or methods.       4.   The developer or owner may appeal a negative decision of the village engineer to the director of building and zoning, the village manager and the village board, in that order.    F.   Reasonable Working Hours And Days:
      1.   Subject to ordinance 88-06-265 of the village, construction activities, including the preparation or delivery of construction equipment or materials, shall begin no earlier than seven o'clock (7:00) A.M. and shall cease no later than seven o'clock (7:00) P.M., Monday through Friday. Construction activities shall begin no earlier than eight o'clock (8:00) A.M. and shall cease no later than five o'clock (5:00) P.M. on Saturday. No construction activity is allowed on Sunday without a special permit. No construction is allowed on the following holidays:
         New Year’s Day
         Memorial Day
         4th of July
         Labor Day
         Thanksgiving
         Christmas
         2.   This provision shall not apply where construction activities are for the prevention of injury to persons or property.
   G.   Materials: Only materials not previously used and in like new condition shall be used in the construction of improvements unless the village engineer approves otherwise in writing. The village engineer shall be given copies of material invoices at his request. He may also inspect the materials at their place of origin.
   H.   Errors And Omissions: Errors and omissions in these standards and specifications shall immediately be brought to the attention of the village engineer. Errors and omissions in these standards and specifications shall in no way relieve a developer or owner, his or her agents, consultants or contractor(s) of the responsibility to provide a developmental environment in full compliance with all pertinent ordinances, regulations, laws, court orders, etc., promulgated by recognized authorities and in full compliance with the stated intent of these standards and specifications.
   I.   Certification: All plats, plans and specifications relevant to the design and construction of any development shall be certified and stamped by a person licensed by the state of Illinois who has been responsible for the surveying or design task entailed.
   J.   Plans: Plans submitted to the village engineer shall include plans for all improvements in a development except buildings. Only the outline and pertinent floor elevations are required for buildings.
   K.   Improvements: Improvements for development shall complement existing improvements in abutting properties or shall conform to the comprehensive plan where abutting properties are not developed.
   L.   Preconstruction Meeting: Shortly after plans for improvements are approved by the village and by other public or quasi-public agencies as required, and after a general contractor is engaged, a preconstruction meeting shall be convened. A representative of the developer or owner, the contractor, the village engineer, and any other person(s) deemed necessary by the village engineer shall attend. Representatives of other public or quasi-public agencies may attend at their option. The meeting time and place and the notification list shall meet the approval of the village engineer.
   M.   Notice; Changes: The developer or owner or the contractor shall notify the village engineer at least forty eight (48) hours before construction is to begin or end. This provision shall apply to the resumption of construction after a break of three (3) days or more and to the temporary halting of construction as for holidays or vacation. Any significant changes in the construction schedule shall be reported to the village engineer.
   N.   Maintenance Warranty: The developer or owner shall provide the village with a two (2) year maintenance warranty for all public improvements. The warranty shall not commence until after the public improvements have been accepted by the village in writing.
   O.   Service Connections: Service connections to be installed under existing roadways in commercial, industrial and multi- family developments shall be augured. Nonmetallic pipe shall be installed in steel casing under the roadway and for five feet (5') beyond the back of curb.
   P.   Additional Insured Parties: The developer or owner and the general contractor shall include the village, its officials and employees, and the village engineer as additional insured parties under all insurance policies required for development in the village.
   Q.   Fencing; Landscaping: Residential areas shall be separated from both commercial and industrial areas by fencing and/or landscaping.
   R.   Water Service: Water service at a site must be complete prior to any building.
   S.   Rumble Strips: All new developments over one acre in size must install a rumble strip at the intersection to prevent mud and debris from leaving the site.
   T.   Road To Storage Sites: The contractor must install a gravel road into a new subdivision where there exists the storage of building materials or flammable materials of any type. (Ord. 89-08-335, 8-21-1989)
   U.   Temporary Roads For New Construction Areas: The contractor shall install a temporary construction gravel road to access any new building construction. The gravel road shall be not less than eighteen feet (18') in width and shall be constructed in a manner to carry the weight of heavy equipment, as determined by the village's director of public works.
