1-8-12: PETITION TO SET ASIDE DETERMINATION OF VIOLATION LIABILITY FOR VIOLATION OF TITLE 6:
   A.   Filing Of Petition: A petition to set aside a determination of liability for violation of title 6 of this code pertaining to automated traffic law violations and violations concerning the parking, standing, and condition of vehicles may be filed by a person owing an unpaid fine or penalty or a person required to complete a traffic education program. Grounds for the petition may include:
      1.   The person was not the owner or lessee of the cited vehicle on the date the violation notice was issued;
      2.   The person already completed the required traffic education program or paid the fine or penalty, or both, for the violation in question; or
      3.   The person's failure to appear at or request a new date for a hearing was excusable.
   B.   Filed With Code Enforcement Administrator: A petition to set aside determination of liability must be filed with the code enforcement administrator within twenty one (21) days after the date of notice of final determination of violation liability.
   C.   Ruling: The code enforcement administrator must rule on a petition to set aside determination of violation liability within fourteen (14) days after receipt of the petition. (Ord. 2010-01-692, 1-18-2010)
