1-8-3: DEFINITIONS:
As used in this chapter, the following terms have the following meanings:
AUTOMATED TRAFFIC LAW ENFORCEMENT SYSTEM OR SYSTEM: The devices located within the village with one or more motor vehicle sensors working in conjunction within a red light signal to produce recorded images of a motor vehicle entering into or remaining within an intersection against a steady red or flashing red signal indicating a violation of section 11-306 of the Illinois vehicle code1.
AUTOMATED TRAFFIC LAW VIOLATION: Any violation of section 11-306 of the Illinois vehicle code2 as recorded by an automated traffic law enforcement system.
BUILDING INSPECTOR: Any full or part time village employee whose duties include the inspection or examination of property or structures in the village to determine if code violations exist.
BUILDING OWNER: The legal or beneficial owner of a structure.
CODE ENFORCEMENT ADMINISTRATOR: Each person appointed by the village manager pursuant to, and having those responsibilities set forth in, section 1-8-7 of this chapter.
CODE HEARING DEPARTMENT: The department under the direction of the office of the village manager that is designed to expedite the prosecution and correction of code and ordinance violations in the manner set out in this chapter.
HEARING: A hearing on an alleged violation conducted pursuant to section 1-8-9 of this chapter.
HEARING OFFICER: Each person appointed by the village president pursuant to, and having those responsibilities set forth in, section 1-8-6 of this chapter.
ILLINOIS ADMINISTRATIVE REVIEW LAW: Section 3-101 et seq., of the Illinois code of civil procedure, 735 Illinois Compiled Statutes 5/3-101 et seq.
ILLINOIS MUNICIPAL CODE: 65 Illinois Compiled Statutes 5/1-1-1 et seq.
RECORDED IMAGES: Images recorded by an automated traffic law enforcement system, which include either two (2) or more photographs, or two (2) or more microphotographs, or two (2) or more electronic images, or a video recording showing the subject motor vehicle, together with at least one clearly recorded image that identifies the subject motor vehicle's license plate and that displays the time, date, and location of the violation.
TRAFFIC EDUCATION PROGRAM: A traffic education program that is satisfactory under state law.
VIOLATION: A violation of a provision of this code or other codes or ordinances designated by the board of trustees, as set forth in section 1-8-2 of this chapter.
VIOLATION NOTICE: A notice of any violation issued pursuant to section 1-8-8 of this chapter. (Ord. 2010-01-692, 1-18-2010; amd. Ord. 2012-10-861, 10-1-2012)
