7-5-20: WATER CONSERVATION REGULATIONS:
   A.   Policy: The Board of Trustees hereby establishes the policy of the Village to protect the Village's water supply system, to maintain at all times adequate water pressure to meet the needs of the Village's Fire/Rescue Department in combating fires, and to provide a consistent level of water capacity for use by residents, commerce and industry. It is necessary therefore to restrict the use of water furnished by the Village's water supply system during certain seasons and under certain conditions, as provided in this section.
   B.   Seasonal Restrictions On Outdoor Water Uses: From June 1 through September 15 of each year, no person shall use water for lawn or garden purposes, washing of automobiles or other outdoor use, except between the hours of five o'clock (5:00) A.M. to ten o'clock (10:00) A.M. and five o'clock (5:00) P.M. and ten o'clock (10:00) P.M. These restrictions shall apply to all commercial, industrial and residential properties except only for the following uses:
      1.   Residential use of water in watering cans and buckets for gardens, annual flowers, and the like; and
      2.   Residential use of water for filling small children's wading pools and water oriented play devices when those play devices are being actively used; and
      3.   Residential use of water for car washing so long as the hose, if any, is fitted with a water shutoff nozzle or valve and the water is shut off when not being applied to rinse the vehicle; and
      4.   A commercial or industrial service involving water usage as part of an ongoing business operation, such as a car wash center. (Ord. 2003-07-233, 7-21-2003)
   C.   Emergency Restriction Of Outdoor Use: The Village Manager, at any time, may restrict some or all outside use of water, except only for a commercial or industrial service involving water usage as part of an ongoing business operation, if the Village Manager determines that an emergency situation exists that threatens the public health or safety. In such event, the Village Manager shall cause notice of the emergency restriction to be given to the general public and news media. The notice shall provide that all outdoor use of water is prohibited until further notice. The Village Manager shall cause notice to be given to the general public and news media of the lifting of such restriction promptly after the condition that required such restriction has been alleviated.    D.   Penalties: Any person, firm, or corporation found guilty of violating any provision of this section shall, on conviction, be fined pursuant to title 13, chapter 1, "Fee Schedule", of this Code for each offense. Each day during which a violation occurs or continues shall be considered a separate offense. Any person, firm or corporation found guilty of violating any provision of this section a second time within the same calendar year shall, on conviction, be fined pursuant to title 13, chapter 1, "Fee Schedule", of this Code. Any person, firm, or corporation found guilty of violating any provision of this section a third or subsequent time within the same calendar year shall, on conviction, be fined pursuant to title 13, chapter 1, "Fee Schedule", of this Code.
