6-8E-2: PENALTIES:
   A.   Citation Fine: Any person to whom a parking citation has been issued under this article, other than for a violation of subsection 6-8A-5A of this chapter, who has removed the offending vehicle from the place where it had been illegally parked (before the vehicle had been removed or impounded by police order) may avoid prosecution for the citation by paying the sum pursuant to title 13, chapter 1, "Fee Schedule", of this Code. At any time after twenty (20) days after such citation is issued, the fine shall be as prescribed in subsection C of this section.
   B.   Disabled Persons Parking Spaces: Any person violating subsection 6-8A-5A of this chapter shall be penalized in accordance with the Illinois Vehicle Code.
   C.   Fines Forwarded For Collection: If the Village of Lake Zurich does not receive payment pursuant to subsection A of this section, then the Village may implement collection proceedings to recover the payment in accordance with the following procedure: (Ord. 2005-02-333, 2-7-2005)
      1.   The Village shall issue notice to the registered owner of the offending vehicle by first class postage prepaid U.S. mail, which notice shall state that the owner may pay pursuant to title 13, chapter 1, "Fee Schedule", of this Code to the Village within ten (10) days after the date of that notice in full satisfaction of the citation, and that, if the payment is not received within the ten (10) day period, then the fine applicable to the violation shall increase pursuant to title 13, chapter 1, "Fee Schedule", of this Code, and that the Village may initiate collection proceedings if payment is not received within the ten (10) day period.       2.   If payment is not received within the ten (10) day period, then the Village shall issue a second notice to the registered owner of the offending vehicle by first class postage prepaid U.S. mail, which notice shall state the following: (Ord. 2005-02-333, 2-7-2005)
         a.   The fine for the violation is pursuant to title 13, chapter 1, "Fee Schedule", of this Code; and
         b.   The fine may be paid on or before a date certain not less than ten (10) days after the date of the second notice; and (Ord. 2005-02-333, 2-7-2005; amd. Ord. 2018-12-279, 12-3-2018)
         c.   If payment is not received, then the Village shall immediately implement collection proceedings against the owner. (Ord. 2005-02-333, 2-7-2005)
   D.   Exceptions: The procedures established in this section shall not apply to the following circumstances:
      1.   Persons parking a vehicle so as to obstruct the entrance or exit of any place where police, fire, or other emergency apparatus or vehicles are located; or
      2.   Persons parking a vehicle so as to block any emergency entrance to any hospital or other medical facility; or
      3.   Persons parking a vehicle so as to entirely obstruct traffic in any street or alley or so as to reduce traffic on any arterial street to one-way traffic only; or
      4.   Persons who refuse to move a vehicle parked illegally at the request of any member of the Lake Zurich Police Department.
The department shall take such actions under these circumstances as may be authorized by law. (Ord. 2005-02-333, 2-7-2005; amd. Ord. 2009-10-666, 10-5-2009)
