A. Requirements For Release: The registered owner of a vehicle towed pursuant to this article may secure the release of the vehicle by furnishing evidence of his or her identity and ownership or possessory right to the vehicle, by signing a receipt for the vehicle, and by paying or causing to be paid to the Village the following fine and fees:
1. Fine: The fine imposed pursuant to section 6-8D-7 of this article.
2. Towing Fee: The towing fee imposed pursuant to subsection 6-8D-13A of this article.
3. Impoundment Fee: The impoundment fee imposed pursuant to subsection 6-8D-13B of this article.
B. Release If Invalidation Of Tow: Notwithstanding any other provision of this article to the contrary, the registered owner of a towed vehicle may remove the vehicle without paying any fine or fee otherwise required to be paid pursuant to this article if the Police Chief determines, on appeal or otherwise, that the tow of the vehicle was not authorized pursuant to this article or was otherwise invalid.
C. Taking Possession: The registered owner shall take possession of the towed vehicle no later than twenty four (24) hours after satisfaction of the requirements for release set forth in subsection A of this section.
D. Hearing Request: After release of a towed vehicle pursuant to this section, the owner of the vehicle in question may subsequently appeal the tow and request a hearing pursuant to section 6-8D-11 of this article. (Ord. 2005-02-333, 2-7-2005)
