5-5-9: WAIVER OF RESPONSE CHARGE:
   A.   Authority: The Fire Chief shall have the authority, but not the obligation, to waive any response charge; provided, however, that every such waiver shall be made only after a finding, based on evidence and testimony presented by the fire alarm user, that one or more of the following circumstances exist:
      1.   Actual Emergency: Evidence of an actual fire or other emergency.
      2.   Power Outage: Evidence of power utility outage conditions lasting eight (8) hours or longer and affecting a general neighborhood area.
      3.   Act Of Nature Or God: Evidence of a tornado, earthquake or other violent and extreme condition of nature or act of God.
      4.   Malicious Act: Evidence of a malicious act of someone not the fire alarm user or his or her agent, employee, servant, or other person within the direction, control or responsibility of the fire alarm user.
      5.   Thirty Day Grace Period: A false alarm occurred during the thirty (30) day period immediately after installation of an alarm system.
   B.   Request; Decision: Requests in writing for a waiver may be made by any fire alarm user to the Fire Chief. Within fourteen (14) days after receipt of such a written request, the Fire Chief shall review the fire alarm user's request in accordance with this section and shall issue a decision.    C.   Appeal: Within fourteen (14) days after receipt of such decision, the fire alarm user may appeal the Fire Chief's decision to the Village Manager, whose determination in accordance with this section shall be final. (Ord. 94-04-659, 4-18-1994; amd. Ord. 2012-10-861, 10-1-2012)
