4-2-1-6: FIREARMS:
   A.   Discharge Of Firearm Within Village Prohibited:
      1.   Except as provided in subsection A2 of this section, it shall be unlawful and a public nuisance for any person to discharge, or to cause the discharge of, any gun, pistol, rifle, or other firearm within the Village.
      2.   The prohibition established in subsection A1 of this section shall not apply to any officer of the law in the performance of his or her duties or to any official governmental activity, or to the discharge of a rifle as part of a traditional ceremonial event such as a funeral conducted by a recognized civic or fraternal organization.
   B.   Discharge Of Firearm Creating Nuisance Prohibited: Except for any officer of the law in the performance of his or her duties, it shall be unlawful and a public nuisance for any person to discharge, or for any person to cause the discharge of, or for any property owner to allow on that owner's property the discharge of, any gun, pistol, rifle, or other firearm in any location in any manner that:
      1.   Substantially annoys, injures, or endangers the comfort, health, repose, or safety of any person within the corporate limits of the Village; or
      2.   In any way renders any person within the corporate limits of the Village insecure in his or her life or in his or her use of property; or
      3.   Creates, places, or causes in the air any object, material, or substance that is dangerous, offensive, nauseous, irritating, or noxious to humans or other animal life within the Village.
   C.   Prohibition Of Certain Businesses And Establishments Involving Discharge Of Firearm: It shall be unlawful and a public nuisance to conduct, within the Village or within one- fourth (1/4) mile of the Village's corporate limits, any offensive or unwholesome business, establishment, or activity involving the discharge of a gun, pistol, rifle, or other firearm. For the purposes of this subsection, an "offensive or unwholesome business, establishment, or activity" shall include, but not be limited to, any activity: 1) that violates any State or local statute, code, ordinance, or regulation, or 2) that substantially annoys, injures, or endangers the comfort, health, repose, or safety of any person within the corporate limits of the Village, or 3) that renders any person within the corporate limits of the Village insecure in his or her life or in his or her use of property, or 4) that creates, places, or causes in the air any object, material, or substance that is dangerous, offensive, nauseous, irritating, or noxious to humans or other animal life within the Village.
   D.   Penalties; Abatement: The penalty provisions set forth in title 1, chapter 3 of this Code, and the abatement provisions of section 4-2-3 of this chapter shall apply to any violation of any provision of this section. (Ord. 2003-12-264, 12-1-2003)
