1335.06 RESTRICTIONS.
   (a)   If high pressure boilers are used for cleaning or other purposes, they shall conform to the Ohio Revised Code and shall be operated in a safe and approved manner.
   (b)   All such operations shall be shielded by tarpaulins or other screening so as to prevent vapor, water, dust and debris from causing a nuisance by falling on pedestrians, vehicles, public thoroughfares and adjoining property.
   (c)   No such operations shall be conducted during rains or snowfalls, when wind speeds exceed fifteen miles per hour or during other conditions determined as being unsafe for such process by the Division of Public Health.
   (d)   Ground tarping shall be used to at least thirty feet from the work surface being stripped or cleaned or to a property line of less than thirty feet and on adjacent sides, to collect as much of the residue as possible to prevent it from falling upon the ground.
   (e)   All vents, windows and other areas through which air might enter the premises upon which the work is being conducted shall be covered to prevent infiltration.
   (f)   No such activity shall be permitted under any permit issued in accordance with this chapter which violates Chapter 515 of the General Offenses Code.
   (g)   No paint removal process that presents a risk of generating dust particles containing lead, nor any gasoline or propane-fired torch, shall be used to remove any lead-based paint on any exterior surface except in compliance with the procedures set forth herein. Where any such process is proposed to be employed, the applicant shall provide the Building Commissioner and the Director of Human Services, in a form acceptable to them, with test results indicating the lead content of the paint to be removed, the cost of such required testing to be borne by the applicant. If the lead content equals or exceeds one mg/cm2 (the current Federally recognized maximum acceptable lead concentration), no permit shall be issued. As a condition of any permit being issued, the property owner shall authorize an agent of the City onto the premises at any time between the hours of 8:00 a.m. and 5:00 p.m., Monday to Friday, to conduct unannounced testing of the paint to be removed, the particles generated by the process and the surfaces affected. If the City's test with an X-ray fluorescence analyzer (XFR), or other method approved by the U.S. Department of Housing and Urban Development (HUD), indicates a lead content equal to or exceeding one mg/cm2, the paint removal shall be immediately halted and the permit revoked.
   (h)   After completion of the work to be performed under the permit, or after revocation of such permit, the permittee shall be required to thoroughly clean up all residue from the permit premises, adjacent property and public rights of way or thoroughfares. In addition, the permittee shall ensure that no paint removal and/or clean-up is performed in such a manner as to cause or create a public nuisance and shall further ensure that the clean-up of the work area is in such a manner as not to cause or create a public nuisance. The permittee shall be required to notify the Building Commissioner of the completion of work and shall respond immediately to any finding of deficiency by the Building Commissioner with regard thereto.
