1331.05 CERTIFICATION OF CHANGE IN OCCUPANCY.
   (a)   After September 1, 1982, at every change in occupancy of every residential rental unit occasioned by or incidental to a sale, lease, or sublease of such unit, it shall be the duty of the grantor thereof (i.e., the seller, lessor, or sublessor as the case may be) to certify in writing, before occupancy to the new occupant that all smoke detectors as required by this chapter (or other applicable laws) are installed and in the proper condition. This provision, as outlined in this paragraph, shall apply to carbon monoxide (CO) detectors on the effective date of this ordinance. Upon receipt of such certification, it shall be the duty of the occupant to maintain all self-contained smoke detectors in good working order by replacing the battery, when needed to keep the smoke detector operating properly, for existing smoke detectors so equipped with replaceable batteries.

   (b)   Failure to comply with this section shall be punishable as set forth herein, provided, however, that this subsection shall not be construed to vitiate or render void any contract, lease, or sublease subject hereto.
