911.02 CHARGES.
   (a)   Definitions. For purposes of this section, the following definitions shall apply:
      (1)   “Solid waste” means wastes from residential and business premises within the City of Lakewood as part of the normal waste services or products of the premises, or construction and demolition debris arising out of improvements made to the residential or business premises in the City of Lakewood, but shall not include any type of waste that the Director of Public Works excludes from the waste stream based upon the requirements of law, rule or regulation, or for any other reasonable cause.
      (2)   “Personal vehicle” means a car, station wagon, van or pickup truck that is registered, or otherwise affiliated by satisfactory evidence, to the owner or resident of the place of residence or business.
      (3)   “Satisfactory evidence” means such documentary presentation or other verification deemed sufficient, in the sole discretion of the Director of Public Works or his designees, to show that the origin of the solid waste or the personal vehicle delivering same are sufficiently connected to the City of Lakewood to permit the deposit of solid waste at the City of Lakewood’s facility, or to permit the deposit without the charges otherwise provided for in this section, including but not limited to building permits, occupancy permits, reference letters, motor vehicle registration, Ohio driver’s license, and such telephone verification procedures as the Director of Public Works may prescribe.
   (b)   Residents of the City, or the owners of residential properties located in the City, may bring refuse, garbage and other solid waste materials arising out of the use of their Lakewood residence or residential property, and construction or demolition debris arising out of improvements made to their property, to the City of Lakewood Division of Refuse and Recycling facility in their own personal vehicle without charge, if personal identification, vehicle registration, and building permit, where applicable, or other satisfactory evidence are provided to establish residence or ownership of property, ownership of vehicle and origin of debris.
   (c)   Owners of business situated in the City may bring refuse, garbage and other solid waste materials arising out of the use of their place of business using their own personal vehicle without charge, if personal identification, vehicle registration and Certificate of Occupancy, or other satisfactory evidence are provided. An owner of a business may designate an employee, and a vehicle affiliated with the business, to transport the refuse with prior approval by the City of Lakewood Division of Refuse and Recycling.
   (d)   Any refuse, garbage or other solid waste materials brought:
      (1)   By, for or on behalf of contractors and commercial haulers, or
      (2)   By residents of the City and owners of businesses situated in the City who bring refuse, garbage or other solid waste materials arising out of the use of their place of residence or business using a vehicle that does not meet the personal vehicle criterion or satisfactory evidence determination of the Director of Public Works or his designee, shall be charged as follows:

Nothing in this subsection shall be construed to limit the power of the Director of Public Works or his designee from prohibiting the deposit of solid waste not originating in the City of Lakewood. Identification, such as a building permit or service contract, or other satisfactory evidence must be provided to establish origin of debris.
   (e)   Vehicles with a gross vehicle weight more than 10,000 pounds shall not be permitted to dump at the City of Lakewood Division of Refuse and Recycling facility.
   (f)   Partial loads may be charged at a lower rate. Vehicles with sideboards or oversize loads may be charged at a higher rate to compensate for the additional load as shall be determined by the City of Lakewood Division of Refuse and Recycling personnel on duty.
   (g)   No refuse, garbage, other waste material, or recyclable materials arising out of the use of premises located outside of the City shall be accepted at the City of Lakewood Division of Refuse and Recycling facility.
   (h)   The Director of Public Works is hereby authorized to establish a schedule of charges, and standards for the waiver of said charges in special circumstances, for special pick-up of bulk items to compensate the City for the cost of removal, transportation and disposal.
