(a) Whoever violates Section 903.09 shall be guilty of a misdemeanor and shall be fined not less than twenty-five dollars ($25.00) nor more than one thousand dollars ($1,000) for a first offense, and for a second or subsequent offense shall be guilty of a misdemeanor of the first degree.
(b) Whoever violates Section 903.10 by failing to comply with a citation and order issued thereunder shall be guilty of a misdemeanor and shall be fined not less than twenty-five dollars ($25.00) nor more than one thousand dollars ($1,000). Each day such violation occurs or continues shall constitute a separate offense.
