§ 156.004 DEFINITIONS.
   (A)   For the purpose of this chapter, certain numbers, abbreviations, terms and words used herein shall be used, interpreted and defined as set forth in this section. Unless the context clearly indicates to the contrary, words used in the present tense include the future tense; words used in the plural number include the singular. In the event of conflicting provisions in the text of this chapter, the more restrictive shall apply.
   (B)   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ADMINISTRATIVE OFFICER. The City Clerk-Administrator or another person appointed by the City Council to administer this chapter.
   ALLEY. Any strip of land publicly or privately owned, less than 33 feet in width between property lines, set aside for public vehicular access to abutting property.
   APPLICANT. The owner of land proposed to be subdivided or their representative. Consent shall be required from the legal owner of the premises.
   ARTERIAL, MINOR. A road intended to move through and from adjacent subregions and activity centers within subregions.
   ARTERIAL ROAD OR HIGHWAY (PRIMARY). A road or highway of considerable continuity designed primarily to serve as an interconnection link between sectors of the city and beyond (such as from within a city to outlying areas).
   ATTORNEY. The ATTORNEY employed by the city unless otherwise stated.
   BACKLOT. Residential lots without water frontage located in the Shoreland Area of the city.
   BACKSLOPE. The portion of the roadway cross-section beginning at the outside edge of the ditch bottom, sloping upward to a point where the slope intersects the existing ground line.
   BLOCK. The enclosed area within the perimeter of roads, property lines or boundaries of the subdivision.
   BOND. Any form of security including a cash deposit, surety BOND, collateral, property or instrument of credit in an amount and form satisfactory to the City Council. All BONDS shall be approved by the City Council wherever a BOND is required by this chapter.
   BOULEVARD. The portion of the street right-of-way between the curb line and the property line.
   BUILDABLE LAND. Land with a slope less than 25 percent, and outside of any required setbacks, except that on a natural environment lake where a 200 foot structure setback is required, the buildable area calculation would be measured from a 150 foot setback rather than the required 200 foot setback; and above any floodway, drainageway, or drainage easement.
   BUILDING. Any structure, either temporary or permanent, having a roof supported by columns, walls, or other means of support and used or built for the shelter or enclosure of any person, animal or property of any kind. When any portion thereof is completely separated from every other part thereof by area separation, each portion of such building shall be deemed as a separate building.
   BUTT LOT. A lot at the end of a block and located between two corner lots.
   CLUSTER DEVELOPMENT. A pattern of subdivision development which places detached houses, duplexes or townhouse units into compact groupings while providing a network of commonly owned or dedicated open space.
   COLLECTOR STREET OR ROAD. A road intended to move traffic from local roads to secondary roads.
   COMMUNITY. This city.
   COMPREHENSIVE DEVELOPMENT PLAN. The policies, statements, goals and interrelated plans for private and public land and water use, transportation and city facilities, including recommendations for planned execution, documented in texts, ordinance and maps which constitute the guide for the future development of the city or any portion of the city.
   CONCEPT PLAN. A sketch preparatory to the preparation of the preliminary plat to enable the applicant to save time and expense in reaching general agreement with the City Council as to the form of the development and the objectives of these regulations. The concept plan shall contain data in accordance with Section 6.1 of this Chapter.
   CONTOUR INTERVAL. The elevation change between contour lines.
   CONTOUR MAP. A MAP on which irregularities of land surface are shown by lines connecting points of equal elevations. CONTOUR interval is the vertical height between CONTOUR lines.
   COPY. A print or reproduction made from a tracing.
   CORNER LOT. A lot bordered on at least two adjacent sides by using streets.
   COUNTY. Washington County, Minnesota.
   CITY COUNCIL. The City Council of Lake St. Croix Beach.
   CUL-DE-SAC. A road having but one end open to traffic and the other end being permanently terminated by a vehicular turnaround.
   DEDICATED STREET. A roadway designated for public use.
   DEVELOPER. The owner of land proposed to be subdivided or their representative. Consent shall be required from the legal owner of the premises.
   DEVELOPMENT. The act of building structures and installing site improvements.
   DEVELOPMENT AGREEMENT. A contract with the City in which the owner or developer agrees to take certain specified actions in consideration of the City's granting preliminary and final plat approval.
   DOUBLE FRONTAGE LOTS. Lots which have a front line abutting on one street and a back or rear line abutting on another street.
   DRAINAGE COURSE. A water course or indenture for the drainage of surface water.
   DRAINAGE WAY: A natural passageway in the surface of the earth so situated and having such a topographical nature that surface water flows through it from other areas before reaching a final ponding area. The term also includes all drainage structures that have been constructed or placed for the purpose of conducting water from one place to another.
   EASEMENT. A grant by an owner of land for a specific use of said land by the public, generally, or to a person or persons.
   ENGINEER. The City Engineer.
   ESCROW. A deposit of cash with the city government in lieu of an amount required and still in force on a performance or maintenance bond. Such ESCROW funds shall be deposited by the Building Inspector and Zoning Administrator in a separate account.
   FEE SCHEDULE. A document setting forth the city's fees for permits, appeals, variances and subdivision filings as adopted by ordinance by the City Council as provided in §30.03. FINAL PLAT. The final map, drawing or chart on which the subdivider's plan of subdivision is presented to the City Council for approval and which, if approved, will be submitted to the County Recorder.
   GOVERNING BODY. The City Council of Lake St. Croix Beach.
   GRADE. The slope of a road, street or other public way, specified in percentage terms.
   HEREIN. In this chapter.
   INDIVIDUAL SEWAGE DISPOSAL SYSTEM. A sewage treatment system or part thereof, serving a dwelling or other establishment, or group thereof, and using sewage tanks or advanced treatment followed by soil treatment and disposal consisting of one or more septic tanks and a soil treatment system.
   INSLOPE. The portion of the roadway cross-section beginning at the outside edge of the roadway shoulder, sloping downward to the inside edge of the ditch bottom.
   LOT. A parcel of land designated by metes and bounds, registered land survey, plat or other means, and which description is either recorded in the office of the County Recorder or Registrar of Titles or used by the County Treasurer or County Assessor to separate such parcel from other lands for tax purposes. A lot must be situated and have its principal frontage on a public street.
   LOT, CORNER. A lot bordered on at least two (2) adjacent sides by intersecting streets.
   MAJOR SUBDIVISION. All subdivisions not classified as minor subdivisions, including but not limited to subdivisions of four or more lots, or any size subdivision requiring any new street or extension of the local government facilities, or the creation of any public improvements.
   MARGINAL ACCESS STREET (SERVICE ROAD). A minor street parallel to and adjacent to high volume arterial streets and highways, which provide access to abutting properties and protection of through traffic.
   METES AND BOUNDS. A description of real property which identifies a parcel of land by its shapes and boundaries, starting at a known point and describing the bearing and distances of lines forming the boundaries of the property or delineating a fractional portion of a section, lot or area by described lines or portions thereof. .
   MINIMUM SUBDIVISION DESIGN STANDARDS. The guides, principles and specifications for the preparation of subdivision plans indicating among other things, the minimum and maximum dimensions of the various elements set forth in the plan.
   MINOR SUBDIVISION. Any SUBDIVISION containing not more than three lots fronting on an existing street, not involving any new street or road, or the extension of municipal facilities, or the creation of any public improvements, and not adversely affecting the remainder of the parcel or adjoining property, and not in conflict with any provisions or portion of the master plan, official map, zoning ordinance, or this chapter.
   NATURAL WATER WAY. A natural passageway in the surface of the earth so situated and having such a topographical nature that surface water flows through it from other areas before reaching a final ponding area. The term also includes all drainage structures that have been constructed or placed for the purpose of conducting water from one place to another.
   NON-RESIDENTIAL SUBDIVISION. A SUBDIVISION whose intended use is other than residential, such as commercial or industrial. Such SUBDIVISION shall comply with the applicable provisions of these regulations. OUTLOT. A lot remnant or any parcel of land included in a plat, which is not Buildable at the time of platting. Such OUTLOT may be a large tract that could be subdivided in the future or may be too small to comply with the minimum size requirements of zoning and subdivision ordinances or otherwise unsuitable for development and therefore not usable as a building site.
   OWNER. Includes all persons interested in a property as fee simple OWNER, life estate holder, encumbrancer or otherwise.
   PEDESTRIAN WAY. A public right-of-way across or within a block, to be used by pedestrians and/or non-motorized vehicles.
   PERSON. Any person, corporation or association including governmental agencies and political entities.
   PLANNING COMMISSION. The duly appointed planning and zoning advisory commission of the city.
   PRELIMINARY PLAT. The preliminary map, drawing, or chart indicating the proposed layout of the subdivision to be submitted to the Planning Commission and City Council for approval. PRELIMINARY PLAT shall contain data required as outlined in § 156.006.
   PRIVATE STREET. A street that is owned by one or more private parties, not dedicated to the public and which provides vehicular access to more than two (2) parcels of land.
   PROTECTIVE COVENANTS. Contracts, agreements, or declarations entered into between private parties and constituting a restriction on the use of all private property within a subdivision for the benefit of the property owners.
   PUBLIC ROAD OR STREET. A particularly described and identified right-of-way, at least 33 feet in width, dedicated to public use for road or highway purposes and to provide right-of-way beneath it for sewer, water and storm drainage pipes.
   RESERVE STRIPS. A narrow strip of land placed between lot lines and streets to control access.
   RESUBDIVISION. A change in a map of an approved or recorded subdivision plat if such change affects any street layout on such map or area reserved thereon for public use, or any lot line; or if it affects any map or plan legally recorded prior to the adoption of any regulations controlling subdivisions.
   RIGHT-OF-WAY. The land covered by a public road or land dedicated for public use or for certain private use such as land over which a power line passes.
   ROAD, DEAD-END. A road or a portion of a street with only one vehicular-traffic outlet.
   SERVICE ROAD. A public road having a traveled surface of at least 24 feet in width lying parallel to and adjacent to an ARTERIAL ROAD OR HIGHWAY and which provides access to abutting properties and protection from through traffic.
   SHALL. Is always mandatory.
   SKETCH PLAN. A drawing showing the proposed subdivision of property. This PLAN is not necessarily drawn to scale and exact accuracy is not a requirement.
   SKETCH PLAT. A sketch preparatory to the preparation of the preliminary plat (or subdivision plat in the case of minor subdivisions) to enable the subdivider to save time and expense in reaching general agreement with the local city and Planning Department as to the form of the plat and the objectives of these regulations.
   STREET WIDTH. The shortest distance between the lines delineating the roadway including shoulders or parking lanes of a street. On urban designed streets it is face to face of curbs.
   STRUCTURE. Any building or appurtenance, including but not limited to, vision obstructing fences, decks, retaining walls, satellite dishes, except aerial or underground utility lines, such as sewer, electric, telephone, telegraph, gas lines, tower poles, and other supporting facilities. Includes any part thereof.
   SUBDIVIDER. Any person commencing proceedings under this chapter to affect a subdivision of land for themself or for another
   SUBDIVISION. The division of a parcel of land after the effective date of this chapter into two or more lots or parcels, for the purpose of transfer of ownership or building development. The term includes resubdivision and, when appropriate to the context, shall relate to the process of subdividing or to the land subdivided.
   SURVEY, LAND. The process of determining boundaries and areas of tracts of land. Also called property survey or boundary survey.
   SURVEYOR. A land SURVEYOR registered under state laws.
   THESE REGULATIONS. This subdivisions chapter.
   THOROUGHFARE. A street primarily designated to carry large volumes of traffic and provide for vehicular movement between and among large areas.
   USED OR OCCUPIED. As applied to any land or building shall be construed to include the words "intended, arranged or designed to be USED OR OCCUPIED."
   VICINITY MAP. A MAP drawn to comparatively small scale which definitely shows the area proposed to be platted in relation to known geographical features, such as town centers, lakes, roads.
   ZONING ORDINANCE. A ZONING ORDINANCE or resolution controlling the use of land as adopted by the city.
