§ 113.001 SUNDAY SALES OF INTOXICATING LIQUOR.
   (A)   Restaurant defined. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
      RESTAURANT.
         (a)   An establishment, other than a hotel, under the control of a single proprietor or manager where meals are regularly served at tables to the general public. The RESTAURANT shall have the minimum seating capacity established within division (B) below.
         (b)   The establishment must possess a license issued by the county pursuant to its Food Protection Ordinance, and the license must be at least a food establishment or limited food handling establishment license.
         (c)   In addition thereto, the RESTAURANT must:
            1.   Have available for sale to the public food items at any time that intoxicating or 3.2% malt liquor is being served within the establishment; and
            2.   Must clearly post within the establishment, or have available by menu, a complete listing of the food items that are offered for sale together with the prices therefor.

   (B)   Sunday sales. All hotels, restaurants or clubs as the same are defined in M.S. § 340A.101, as it may be amended from time to time, the definitions of which are hereby adopted by reference, which have facilities for serving not less than 30 guests at one time, may serve intoxicating liquors between the hours of 10:00 a.m. on Sunday and 1:00 a.m. on Monday in conjunction with the serving of food, provided that the licensed establishment is in conformance with the State Clean Indoor Air Act, being M.S. §§ 144.411 et seq.

   (C)   Special license required. No establishment to which “On Sale” licenses have been issued or hereafter may be issued for the sale of intoxicating liquors which are hotels or restaurants as defined in M.S. § 340A.504, may serve intoxicating liquors on Sundays without first having received a special license to do so as provided in this section.

   (D)   Provisions of Ordinance No. 1201 adopted. The provisions of Ordinance No. 1201, an ordinance licensing and regulating the sale and consumption of intoxicating liquor and providing a penalty for violation, with reference to the definition of terms, application for license, granting of license, conditions of license, restrictions on consumption, and all other matters pertaining to the sale and consumption of intoxicating liquor, are hereby adopted and made a part of this section as if fully set out herein.
