The Minnesota State Fire Code, as adopted and amended from time to time by the commissioner of public safety pursuant to Minn. Stats. Ch. 299F.011 and as modified by Minnesota Rules, Chapter 7511, is hereby adopted by reference, including all appendices, and incorporated in this section as completely as if set out in full.
(A) ENFORCEMENT.
(1) The Fire Code adopted in this article shall be enforced by the Fire Department in the Fire Protection District, which is hereby established, and which shall be operated under the supervision of the Fire Chief.
(2) The Fire Chief may detail such members of the service as inspectors as shall from time to time be necessary.
(B) DEFINITIONS.
(1) Wherever the term "jurisdiction" is used in the Fire Code adopted in this article, it shall be held to mean the Cities within the Lower St. Croix Valley Fire Protection District (Afton, Lakeland, Lakeland Shores, St. Mary's Point and Lake St. Croix Beach).
(2) Whenever the term "corporation counsel" is used in the Fire Code adopted in this article, it shall be held to mean the attorney for the city.
(C) UNLAWFUL ACT. It is unlawful for any person to violate any section of this article or the Fire Code adopted by this article.
(D) ESTABLISHMENT AND DUTIES OF THE FIRE MARSHAL
(1) The Minnesota State Fire Code shall be enforced by the Fire Chief of the Lower St. Croix Valley Fire Department.
(2) The Fire Marshal shall be appointed by the Fire Chief.
(3) Whenever the term State Fire Marshal or Fire Chief appear in the Minnesota State Fire Code, it shall include the Fire Marshal of the Lower St. Croix Valley Fire Department.
(4) The Chief of the Lower St. Croix Valley Fire Department may detail members of the department as Fire Inspectors.
(5) Fire Inspectors are responsible for the examination of Buildings to detect fire hazards and ensure that all federal, state, and local fire codes are met, and also may be responsible for plan review as directed.
(6) Fire Marshal and/or Fire Inspectors are responsible for the examination of the Buildings to detect fire hazards and ensure that all federal, state, and local fire codes are met. Additional duties include fire code enforcement, and/or investigation of fire cause and origin. They are also responsible for approval of work permits, and Building plan review to assure that all new and existing construction meets all federal, state, and local Building codes.
(E) FIRE PREVENTION INSPECTION. The Fire Code official is authorized to enter and examine any Building, structure, marine vessel, vehicle or premises in accordance with Section 104.3 for the purpose of enforcing this code. (107.1 Inspection Authority)
(F) OPEN BURNING.
(1) Open burning shall comply with the Minnesota State Fire Code, Section 307 and Minn. Stat. §§ 88.16, 88.17, 88.171, and 88.22.
(2) Permits. Except as allowed under Minn. Stat. § 88.16, subd. 2, it is unlawful for any person to have an open fire without first obtaining a permit from the Fire Chief. The open burning permit may include such conditions as are reasonable under the circumstances.
(G) Building Addresses.
(1) It shall be the duty of the Owner, lessor, and/or occupant of every house, apartment, duplex, industrial, commercial, or other Building to have house and/or Building numbers clearly displayed thereon, either by affixing to said Building or sign post, such numbers in metal, glass, plastic, or other durable material. The numbers shall not be less than 3 inches in height, in a contrasting color to the base (i.e. white numbers on a red base). Said numbers shall be so placed as to be easily and clearly seen from the street when approached from either direction. As to any property with a lengthy driveway or thick trees such that the house or Building is not readily visible from the street, the Owner, lessor and/or occupant shall additionally place an additional marker or sign post near the end of the driveway with the Building numbers clearly displayed so as to be easily and clearly seen from the street.
(2) All accessory structures (as that term is defined within the Zoning Code) are not affected by this Ordinance. The Zoning Administrator and/or Building Inspector for the City shall be responsible for maintaining order in the numbering system, and shall assign numbers for all properties within the City upon request. The Owner or occupant shall affix the numbers on all Buildings and be in compliance from and after February 1, 1987.
