§ 94.26 NUISANCE DECLARED.
   (A)   The following things are public nuisances wherever they may be found within the city:
      (1)   Any living or standing tree or part thereof infected to any degree with disease, fungus, or infestation;; and
      (3)   Any dead tree or part thereof, including logs, branches, stumps, firewood, or other tree material from which the bark has not been removed and burned or sprayed with an effective insecticide.
   (B)   It is unlawful for any Person to permit any public nuisance as defined in division (A) above to remain on any premises owned or controlled by them within the city. Such nuisance may be abated in the manner prescribed by this subchapter.
