§ 93.02 PUBLIC NUISANCES
The following are hereby declared to be public nuisances affecting health, safety, order, convenience, and the general welfare:
   (A)   Decayed food. Exposed accumulation of decayed or unwholesome food or vegetable matter offered for sale to the public;
   (B)   Diseased animals. All diseased animals running at large;
   (C)   Carcasses. Carcasses of animals not burned or destroyed within 24 hours after death;
   (D)   Manure and rubbish. Accumulations of manure, refuse or other debris;
   (E)   Garbage cans. Privy vaults and garbage cans which are not rodent-free or fly-tight or which are so maintained as to constitute a health hazard or to emit foul and disagreeable odors;
   (F)   Cesspool contents. The pollution of any public well or cistern, stream or lake, canal, or body of water by sewage, industrial waste, or other substances;
   (G)   Accumulation of trash and debris. An accumulation of tin cans, bottles, trash or debris of any nature or description; and the throwing, dumping, or depositing of any dead animals, manure, or description; and the throwing, dumping or depositing of dead animals, manure, garbage, waste, decaying matter, ground sand, stones, ashes, rubbish, tin cans or other material of any kind on private property;
   (H)   Smoke and fumes. Dense smoke, noxious fumes, gas and soot or cinders in unreasonable quantities;
   (I)   Exposure of diseased persons. All public exposure of persons having contagious disease;
   (J)   Offensive trade or business. Any offensive trade or business as defined by statute not operating under local license;
   (K)   Vibrations. All unnecessary and annoying vibrations;
   (L)   Gambling devices. All gambling devices, slot machines and punch boards, except as otherwise authorized and permitted by federal, state, or local law.
   (M)   Betting. Betting, bookmaking, and all apparatuses used in such occupations.
   (N)   Illegal liquor. All places where intoxicating liquors are manufactured or disposed in violation of law, or where, in violation of law, persons are permitted to resort for the purpose of drinking intoxicating liquors, or where intoxicating is kept for sale or disposition in violation of law, and all liquors, bottles, kegs, pumps, bars and other property kept at and used for maintaining such a place; For the purposes of this section INTOXICATING LIQUOR shall mean any ethyl alcohol, distilled, fermented, spirituous, vinous or malt beverage containing more than ½% alcohol by volume;
   (O)   Illegal consumption. Unlawful consumption of intoxicating liquor public beaches or parks;
   (P)   Cannabis Use. Use of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in public beaches or parks.
      (1)   Penalty. Any person who engages in the use of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in in public beaches or parks is guilty of a petty misdemeanor in accordance with Minnesota Statute 609.02 Subd. 4a as it may be amended from time to time; and the cost of prosecution may be added pursuant to Minn. Stat. §631.48.
   (Q)   Tobacco Use. Use of tobacco or tobacco products in public beaches or parks.
      (1)   Penalty. Any person who engages in the use of tobacco or tobacco products in public beaches or parks is guilty of a petty misdemeanor in accordance with Minnesota Statute 609.02 Subd. 4a as it may be amended from time to time; and the cost of prosecution may be added pursuant to Minn. Stat. §631.48;
   (R)   Illegal vehicles. Any vehicle used for the illegal transportation of intoxicating liquor, or for promiscuous sexual intercourse, or any other immoral or illegal purpose;
   (S)   Window peeping. The looking into or peeping through doors, windows, or openings of private homes by methods of stealth and without proper authority and by surreptitious methods, or what is commonly known as window peeping;
   (T)   Snow on sidewalks. All snow and ice not removed from public sidewalks 12 hours after the snow and ice has ceased to be deposited thereon;
   (U)   Obstruction of view of traffic. All trees, hedges, billboards, or other obstructions which prevent persons from having a clear view of traffic approaching an intersection from cross streets in sufficient time to bring a motor vehicle driven at a reasonable speed to a full stop before the intersection is reached;
   (V)   Low limits. All limbs of trees which are below the minimum clearance established under 94.05 (B);
   (W)   Low wires. All wires which are strung less than 15 feet above the surface of any public street or alley;
   (X)   Noise. All obnoxious noises in violation of Minn. Rules Ch. 7030, as they may be amended from time to time which are hereby incorporated by reference into this code;
   (Y)   Obstruction and excavation. Obstructions and excavations affecting the ordinary use of the public streets, alleys, sidewalks, or public grounds except under such conditions as are provided by ordinance, and any other excavation left unprotected or uncovered indefinitely or allowed to exist in such manner as to attract people;
   (Z)   Junk. The piling, storing, or keeping of old machinery, wrecked or junked vehicles and other junk or debris;
   (AA)   Obstruction of streets. Any use of property abutting on a public street or sidewalk, or use of a public street or sidewalk which causes large crowds of people to gather obstructing traffic and the free use of public streets or sidewalks;
   (BB)    Signs over streets. All hanging signs, awnings and other similar structures over public streets or sidewalks, or so situated as to endanger public safety, not constructed, and maintained as provided bylaw, or without proper permit;
   (CC)   Water from buildings. The allowing of rain, water, ice, or snow to fall from any building on any public street or sidewalk or to flow across any public sidewalk;
   (DD)   Attractive dangers. All dangerous, unguarded machinery, equipment, or other property in any public place, or so situated or operated on private property as to attract the public;
   (EE)   Material from air. The placing, throwing, dropping, or releasing printed matter, paper or any other material or objects over the city from an airplane, balloon, or other aircraft, or in such, manner as to cause such material to fall or land in the city;
   (FF)   Altering drainage. Obstructing the free flow of water in a natural waterway or public street drain, gutter, or ditch with trash or other materials;
   (GG)   Repairing vehicles on streets. Making repairs to motor vehicles or tires in public streets or alleys, excepting only emergency repairs when it will not unduly impede or interfere with traffic;
   (HH)   Trash in streets. Throwing, placing, depositing, or burning leaves, trash, lawn clippings, weeds, grass or other material in the streets, alleys or gutters;
   (II)   Interference with radios or television. All unnecessary interference with and disturbance of radios or television sets caused by defective electrical appliances and equipment or improper operation thereof;
   (JJ)   Fire hazards. Any building or structure which, by reason of age, dilapidated condition, defective chimneys or stove pipes, defective electric wiring, defective gas connections, defective heating apparatus or other defect, is susceptible to fire, and which thus endangers life or limb or other buildings or property within the city; and any accumulations of brush, timber or other materials or substance on either vacant or improved property, which accumulations are susceptible to fire or capable of spreading fire to adjacent property;
   (KK)   Other acts detrimental to health, peace and safety. All other conditions, acts, omission, uses, or things which are liable to cause injury to the person or property of anyone or are deemed by the Board of Health to be a menace to the health of the inhabitants of the city or a considerable number thereof.
