A. Under existing and proposed water service contracts, a total water supply of 28,331.7 acre-feet per annum is available to the city for use within its water service area. However, 2,139 acre-feet of this amount, as stipulated in the current subcontract through the Mohave County Water Authority, may only be utilized under normal Colorado River supply conditions when the projected annual water demand exceeds the rest of the city's entitlement (currently 26,192.7 acre-feet). Water demands up to 26,192.7 acre-feet during normal supply conditions will be budgeted by the city in the following way:
1. For all existing and future municipal water uses within the LHIDD: 16,000 acre-feet.
2. For water service pursuant to contract with Horizon Six Improvement District, Sunset Mobile Home Park and Anasazi Pueblo, Incorporated: 331 acre-feet.
3. For dedication of evaporative losses of the English Village marina: 12.7 acre-feet.
4. For all existing and future municipal water service outside the LHIDD: 9,849 acre-feet.
B. When demand of the above volumes has been collectively met, up to 2,139 acre-feet of additional Colorado River water allocation becomes available for water service anywhere within the city's entire water service area.
C. The establishment of this water budget is intended to account for all annual consumptive uses of Colorado River water allocated to the city, in concert with Reclamation contract provisions. The water budget set forth in § 7.08.040A hereof may be adjusted periodically in response to changing water demands, water supply availability (including federally declared Colorado River water shortages) and subsequent implementation of water conservation measures set forth in § 7.12.010, § 7.20.020 hereof and in the city's Water Conservation Plan to make maximum use of its water supply. The water budget does not constitute a guarantee of availability of water for new uses.
D. The receipt or withdrawal by any person or entity of any Colorado River water allocated to the city is conditioned upon payment to the city of any applicable fees or charges and compliance with all applicable laws, rules and regulations, including but not limited to the measures set forth in this water allocation and management program.
