§ 150.485 GUARANTEE DEPOSIT.
   (A)   (1)   Before issuance of a permit as provided in § 150.482, a guarantee deposit shall be submitted in accordance with the most recent fee schedule, approved by the City Council, on file in the Office of the Director of Community Development to guarantee the proper completion of the drive approach and proper restoration of pavement, curb, parkway, sidewalk or other improvement. If any such pavement, curb, parkway, sidewalk or other improvement is damaged and not repaired upon completion of the drive approach, the Director of Community Development shall cause the repairs to be made, the cost of which plus all expenses incurred by the city as a result of noncompliance with this subchapter shall be deducted from the guarantee deposit.
      (2)   The guarantee deposit or the residuum of such shall be returned to the depositor upon completion of the work and final inspection of the premises.
   (B)   In those cases where extensive modifications of existing public improvements are required, the guarantee deposit shall be increased to an amount equal to an estimated cost of the project.
   (C)   If a drive approach for which a permit has been issued is not completed in accordance with this subchapter within six calendar months from the date of such permit, or prior to occupancy of the building served by the drive approach, the Director of Community Development may declare the applicant in default, the permit void and proceed to have the incomplete drive approach removed and the site restored to the condition existing prior to the issuance of such permit, or, in the alternative, may proceed to have the drive approach completed. The cost of such removal or completion work shall be deducted from the guarantee deposit.
   (D)   The Director of Community Development may grant an extension of time for completion of such drive approach if weather conditions are such that it is impractical to apply finishing materials. The extension of time however, shall not exceed 12-calendar months from the date of issuance of the original permit.
