§ 171.070 APPROVAL CONDITIONS FOR PROPOSED SUBDIVISIONS.
   (A)   General. When onsite wastewater treatment systems are to be used for a subdivision, the applicant shall submit, for review by the Health Officer, a soil suitability report and/or soils evaluation prepared by a Lake County licensed Soil Classifier/Soil Scientist, in accordance with the requirements of §§ 171.085 through 171.089, that establishes that each proposed lot contains an area suitable for an onsite wastewater treatment primary and reserve soil treatment area. Proposed subdivisions shall be reviewed for the following:
      (1)   Suitability. The suitability of each lot shall be determined by the results of the soil evaluations that are conducted in accordance with the requirements of §§ 171.085 through 171.089 and by the platting of proposed lots in accordance with the requirements of §§ 171.125 through 171.128.
      (2)   Subdivision plans. An Illinois Licensed Professional Engineer shall prepare, seal and sign plans for a subdivision except as authorized by the Health Officer. Any onsite wastewater treatment system depicted on the plans shall be designed by a licensed onsite wastewater treatment system designer.
      (3)   Review of plans. Each lot served by an onsite wastewater treatment system shall have an area of suitable soil for wastewater disposal sufficient for both a primary and a reserve soil treatment area, with respect to soil conditions and system design. The location of an existing onsite wastewater treatment system that will remain shall comply with the requirements of Appendix D.
      (4)   Area protection. All designated primary and reserve soil treatment areas must be protected
from damage during the construction of the infrastructure of the subdivision. Temporary fencing shall be placed to protect soil treatment areas.
